55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to commissioners court quorum requirements and voting
88 requirements applicable to the levying of a county tax.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 81.006(a) and (c), Local Government
1111 Code, are amended to read as follows:
1212 (a) Three members of the commissioners court constitute a
1313 quorum for conducting county business [except the levying of a
1414 county tax].
1515 (c) A county may not levy a tax unless at least four [three]
1616 members of the court vote in favor of the levy.
1717 SECTION 2. Section 81.006(b), Local Government Code, is
1818 repealed.
1919 SECTION 3. The changes in law made by this Act apply only to
2020 a vote by a commissioners court on the question of levying a tax
2121 taken on or after the effective date of this Act. A vote by a
2222 commissioners court on the question of levying a tax taken before
2323 the effective date of this Act is governed by the law in effect when
2424 the vote was taken, and the former law is continued in effect for
2525 that purpose.
2626 SECTION 4. This Act takes effect September 1, 2023.
