77 relating to the disposition of surplus traffic and roadwork safety
88 equipment by the Department of Public Safety and Texas Department
99 of Transportation.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter F, Chapter 2175, Government Code, is
1212 amended by adding Section 2175.309 to read as follows:
1313 Sec. 2175.309. EXCEPTION FOR CERTAIN DEPARTMENT OF PUBLIC
1414 SAFETY AND DEPARTMENT OF TRANSPORTATION SURPLUS PROPERTY. (a)
1515 Notwithstanding any other provision of this chapter, to support the
1616 shared mission of the Department of Public Safety and Texas
1717 Department of Transportation to ensure the safety of emergency
1818 service personnel working on or near this state's highways, the
1919 departments may directly donate or sell at a discounted rate
2020 surplus traffic and roadwork safety equipment, including lights and
2121 safety flags, to a political subdivision of this state.
2222 (b) The departments:
2323 (1) shall donate or sell surplus traffic and roadwork
2424 safety equipment under this section in "as-is" condition; and
2525 (2) may not make any representations or warranties as
2626 to the condition or use of traffic and roadwork safety equipment
2727 donated or sold under this section.
2828 (c) Revenue from any sale of equipment under this section
2929 shall be deposited, as applicable, to the credit of the Department
3030 of Public Safety or Texas Department of Transportation and may be
3131 appropriated only to the applicable department.
3232 SECTION 2. This Act takes effect September 1, 2023.
