10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter F, Chapter 2175, Government Code, is |
---|
12 | 12 | | amended by adding Section 2175.309 to read as follows: |

13 | 13 | | Sec. 2175.309. EXCEPTION FOR CERTAIN DEPARTMENT OF PUBLIC |
---|
14 | 14 | | SAFETY AND DEPARTMENT OF TRANSPORTATION SURPLUS PROPERTY. (a) |
---|
15 | 15 | | Notwithstanding any other provision of this chapter, to support the |
---|
16 | 16 | | shared mission of the Department of Public Safety and Texas |
---|
17 | 17 | | Department of Transportation to ensure the safety of emergency |
---|
18 | 18 | | service personnel working on or near this state's highways, the |
---|
19 | 19 | | departments may directly donate or sell at a discounted rate |
---|
20 | 20 | | surplus traffic and roadwork safety equipment, including lights and |
---|
21 | 21 | | safety flags, to a political subdivision of this state. |
---|
22 | 22 | | (b) The departments: |
---|
23 | 23 | | (1) shall donate or sell surplus traffic and roadwork |
---|
24 | 24 | | safety equipment under this section in "as-is" condition; and |
---|
25 | 25 | | (2) may not make any representations or warranties as |
---|
26 | 26 | | to the condition or use of traffic and roadwork safety equipment |
---|
27 | 27 | | donated or sold under this section. |
---|
28 | 28 | | (c) Revenue from any sale of equipment under this section |
---|
29 | 29 | | shall be deposited, as applicable, to the credit of the Department |
---|
30 | 30 | | of Public Safety or Texas Department of Transportation and may be |
---|
31 | 31 | | appropriated only to the applicable department. |
---|
32 | 32 | | SECTION 2. This Act takes effect September 1, 2023. |
