| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter A, Chapter 92, Property Code, is |
|---|
| 10 | 10 | | amended by adding Section 92.027 to read as follows: |
|---|
| 11 | 11 | | Sec. 92.027. PET DEPOSITS OR FEES. If a lease allows a |
|---|
| 12 | 12 | | tenant to have a pet on the premises, the landlord may collect from |
|---|
| 13 | 13 | | the tenant a one-time refundable pet deposit at the initiation of |
|---|
| 14 | 14 | | the lease or a monthly fee for the pet that does not exceed $20, but |
|---|
| 15 | 15 | | not both. |

| 16 | 16 | | SECTION 2. Section 92.027, Property Code, as added by this |
|---|
| 17 | 17 | | Act, applies only to a lease entered into or renewed on or after the |
|---|
| 18 | 18 | | effective date of this Act. A lease entered into or renewed before |
|---|
| 19 | 19 | | the effective date of this Act is governed by the law as it existed |
|---|
| 20 | 20 | | immediately before the effective date of this Act, and that law is |
|---|
| 21 | 21 | | continued in effect for that purpose. |

| 22 | 22 | | SECTION 3. This Act takes effect September 1, 2023. |
