55 relating to judicial statistics and other pertinent information
66 gathered by the Texas Judicial Council and certain populous

88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 71.035, Government Code, is amended by
1010 amending Subsection (a) and adding Subsections (a-1), (a-2), and
1111 (a-3) to read as follows:
1212 (a) The council shall gather judicial statistics and other
1313 pertinent information, including for each trial court in this state
1414 monthly court activity statistics and case-level information on the
1515 amount and character of the business transacted by the court, from
1616 the several state judges and other court officials of this state.
1717 The monthly information gathered by the council for each trial
1818 court in a county with a population of at least one million must
1919 include, but is not limited to:
2020 (1) the number of cases assigned to the court;
2121 (2) the case clearance rate for the court;
2222 (3) the number of cases disposed by the court;
2323 (4) the number of jury panels empaneled for the court;
2424 (5) the number of orders of continuance for an
2525 attorney before the court or by the court;
2626 (6) the number of pleas accepted by the court;
2727 (7) the number of cases tried by the judge of the court
2828 or before a jury; and
2929 (8) the number of cases tried before a visiting or
3030 associate judge of the court.
3131 (a-1) The [In addition, the] council shall implement a
3232 monthly tracking system to ensure accountability for counties and
3333 courts which participate in the statewide integrated system for
3434 child support, medical support, and dental support enforcement
3535 established under Section 231.0011, Family Code. As a duty of
3636 office, the district clerks and county clerks serving the affected
3737 courts shall report monthly such information as may be required by
3838 the council, including, at a minimum, the time required to enforce
3939 cases from date of delinquency, from date of filing, and from date
4040 of service until date of disposition. Such information as is
4141 necessary to complete the report and not directly within the
4242 control of the district or county clerk, such as date of
4343 delinquency, shall be provided to the clerk by the child support
4444 registry or by the enforcement agency providing Title IV-D
4545 enforcement services in the court.
4646 (a-2) A [The] monthly report required by Subsection (a) or
4747 (a-1) must [shall] be transmitted to the Office of Court
4848 Administration of the Texas Judicial System no later than the 20th
4949 day of the month following the month reported, in the [such] form
5050 and manner [as may be] prescribed by the office [Office of Court
5151 Administration], which may include electronic data transfer. The
5252 office shall publish the information for each court on the office's
5353 public Internet website in a searchable format.
5454 (a-3) In a county with a population greater than one
5555 million, a court official for each court in the county shall submit
5656 to the appropriate county official for publication on the county's
5757 public Internet website a copy of each monthly report required
5858 under Subsections (a) and (a-1) within the time required by
5959 Subsection (a-2). The county shall publish the information for
6060 each court on the county's Internet website in a searchable format
6161 [Copies of such reports shall be maintained in the office of the
6262 appropriate district or county clerk for a period of at least two
6363 years and shall be available to the public for inspection and
6464 reproduction].
6565 SECTION 2. As soon as practicable after the effective date
6666 of this Act, the Texas Judicial Council shall adopt any rules
6767 necessary to implement the changes in law made by this Act.
6868 SECTION 3. This Act takes effect September 1, 2023.
