55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prescribing and ordering of Schedule II controlled
88 substances by certain advanced practice registered nurses and
99 physician assistants.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 157.0511(b-1), Occupations Code, is
1212 amended to read as follows:
1313 (b-1) A physician may delegate the prescribing or ordering
1414 of a controlled substance listed in Schedule II as established by
1515 the commissioner of the Department of State Health Services under
1616 Chapter 481, Health and Safety Code, only:
1717 (1) in a hospital facility-based practice under
1818 Section 157.054, in accordance with policies approved by the
1919 hospital's medical staff or a committee of the hospital's medical
2020 staff as provided by the hospital bylaws to ensure patient safety,
2121 and as part of the care provided to a patient who:
2222 (A) has been admitted to the hospital for an
2323 intended length of stay of 24 hours or greater; or
2424 (B) is receiving services in the emergency
2525 department of the hospital; [or]
2626 (2) as part of the plan of care for the treatment of a
2727 person who has executed a written certification of a terminal
2828 illness, has elected to receive hospice care, and is receiving
2929 hospice treatment from a qualified hospice provider; or
3030 (3) as part of a narcotic drug treatment program that
3131 has been issued a permit under Chapter 466, Health and Safety Code.
3232 SECTION 2. Subchapter A, Chapter 562, Occupations Code, is
3333 amended by adding Section 562.017 to read as follows:
3434 Sec. 562.017. CERTAIN PRESCRIPTIONS FOR CONTROLLED
3535 SUBSTANCES. A pharmacist practicing in a Class A pharmacy may
3636 dispense a controlled substance listed in Schedule II as
3737 established by the commissioner of state health services under
3838 Chapter 481, Health and Safety Code, that is prescribed by an
3939 advanced practice registered nurse or physician assistant to whom a
4040 physician has delegated prescribing and ordering authority under
4141 Section 157.0511(b-1). The prescriber shall clearly note in the
4242 prescription records that the controlled substance listed in
4343 Schedule II is prescribed as part of the care provided:
4444 (1) in a hospital facility-based practice described by
4545 Section 157.0511(b-1)(1);
4646 (2) as part of a plan of care described by Section
4747 157.0511(b-1)(2); or
4848 (3) as part of a narcotic drug treatment program
4949 described by Section 157.0511(b-1)(3).
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2023.
