44 AN ACT
55 relating to the duration of services provided under Medicaid to
66 women following a pregnancy.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. LEGISLATIVE PURPOSE. Out of the state's
99 profound respect for the lives of mothers and unborn children,
1010 Medicaid coverage is extended for mothers whose pregnancies end in
1111 the delivery of the child or end in the natural loss of the child.
1212 SECTION 2. Section 32.024(l-1), Human Resources Code, is
1313 amended to read as follows:
1414 (l-1) The commission shall continue to provide medical
1515 assistance to a woman who is eligible for medical assistance for
1616 pregnant women for a period of not less than:
1717 (1) six months following the date the woman delivers
1818 or experiences an involuntary miscarriage; and
1919 (2) 12 months that begins on the last day of the
2020 woman's pregnancy and ends on the last day of the month in which the
2121 12-month period ends in accordance with Section 1902(e)(16), Social
2222 Security Act (42 U.S.C. Section 1396a(e)(16)).
2323 SECTION 3. As soon as practicable after the effective date
2424 of this Act, the executive commissioner of the Health and Human
2525 Services Commission shall, in accordance with Section 1902(e)(16),
2626 Social Security Act (42 U.S.C. Section 1396a(e)(16)), seek from the
2727 appropriate federal agency an amendment to the state's Medicaid
2828 state plan to implement Section 32.024(l-1)(2), Human Resources
2929 Code, as added by this Act. The commission may delay implementing
3030 this Act until the state plan amendment is approved.
3131 SECTION 4. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2023.
