| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 41.001(a), Election Code, is amended to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (a) Except as otherwise provided by this subchapter, each |
|---|
| 12 | 12 | | general or special election in this state shall be held on one of |
|---|
| 13 | 13 | | the following dates: |
|---|
| 14 | 14 | | (1) the fourth Tuesday [first Saturday] in May in an |
|---|
| 15 | 15 | | odd-numbered year; |
|---|
| 16 | 16 | | (2) the fourth Tuesday [first Saturday] in May in an |
|---|
| 17 | 17 | | even-numbered year, for an election held by a political subdivision |
|---|
| 18 | 18 | | other than a county, or ordered by the governor; or |
|---|
| 19 | 19 | | (3) the first Tuesday after the first Monday in |
|---|
| 20 | 20 | | November. |

| 21 | 21 | | SECTION 2. Section 41.007(d), Election Code, is amended to |

| 22 | 22 | | read as follows: |
|---|
| 23 | 23 | | (d) Except as provided by Sections 41.001(a)(1) and (2), no |

| 24 | 24 | | [No] other election may be held on the date of a primary election. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
