| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 501, Government Code, is |

| 11 | 11 | | amended by adding Section 501.028 to read as follows: |

| 12 | 12 | | Sec. 501.028. TEMPERATURE REQUIREMENTS AT DEPARTMENT |
|---|
| 13 | 13 | | FACILITIES. The department shall ensure that the temperature in |
|---|
| 14 | 14 | | each facility operated by the department is maintained at not less |
|---|
| 15 | 15 | | than 65 degrees Fahrenheit or more than 85 degrees Fahrenheit. |

| 16 | 16 | | SECTION 2. The Texas Department of Criminal Justice is not |
|---|
| 17 | 17 | | required to comply with the requirements of Section 501.028, |
|---|
| 18 | 18 | | Government Code, as added by this Act, until September 1, 2024. |
|---|
| 19 | 19 | | SECTION 3. This Act takes effect September 1, 2023. |
