44 A BILL TO BE ENTITLED
55 AN ACT
66 relating to the definition of and certain determinations regarding
77 emergency care for purposes of certain health benefit plan
88 coverage.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 843.002(7), Insurance Code, is amended
1111 to read as follows:
1212 (7) "Emergency care" means health care services
1313 provided in a hospital emergency facility, freestanding emergency
1414 medical care facility, or comparable emergency facility to evaluate
1515 and stabilize medical conditions of a recent onset and severity,
1616 including severe pain, regardless of the final diagnosis of the
1717 conditions, that would lead a prudent layperson possessing an
1818 average knowledge of medicine and health to believe that the
1919 individual's condition, sickness, or injury is of such a nature
2020 that failure to get immediate medical care could:
2121 (A) place the individual's health in serious
2222 jeopardy;
2323 (B) result in serious impairment to bodily
2424 functions;
2525 (C) result in serious dysfunction of a bodily
2626 organ or part;
2727 (D) result in serious disfigurement; or
2828 (E) for a pregnant woman, result in serious
2929 jeopardy to the health of the fetus.
3030 SECTION 2. Subchapter A, Chapter 843, Insurance Code, is
3131 amended by adding Section 843.011 to read as follows:
3232 Sec. 843.011. EMERGENCY SERVICE DETERMINATIONS. Nothing in
3333 this subchapter prohibits a health maintenance organization from
3434 considering diagnosis codes to detect fraud or abuse.
3535 SECTION 3. Section 1301.155(a), Insurance Code, is amended
3636 to read as follows:
3737 (a) In this section, "emergency care" means health care
3838 services provided in a hospital emergency facility, freestanding
3939 emergency medical care facility, or comparable emergency facility
4040 to evaluate and stabilize a medical condition of a recent onset and
4141 severity, including severe pain, regardless of the final diagnosis
4242 of the condition, that would lead a prudent layperson possessing an
4343 average knowledge of medicine and health to believe that the
4444 person's condition, sickness, or injury is of such a nature that
4545 failure to get immediate medical care could result in:
4646 (1) placing the person's health in serious jeopardy;
4747 (2) serious impairment to bodily functions;
4848 (3) serious dysfunction of a bodily organ or part;
4949 (4) serious disfigurement; or
5050 (5) in the case of a pregnant woman, serious jeopardy
5151 to the health of the fetus.
5252 SECTION 4. Subchapter D, Chapter 1301, Insurance Code, is
5353 amended by adding Section 1301.166 to read as follows:
5454 Sec. 1301.166. EMERGENCY SERVICE DETERMINATIONS. Nothing
5555 in this subchapter prohibits a preferred provider benefit plan from
5656 considering diagnosis codes to detect fraud or abuse.
5757 SECTION 5. Section 4201.002(2), Insurance Code, is amended
5858 to read as follows:
5959 (2) "Emergency care" means health care services
6060 provided in a hospital emergency facility or comparable facility to
6161 evaluate and stabilize medical conditions of a recent onset and
6262 severity, including severe pain, regardless of the final diagnosis
6363 of the conditions, that would lead a prudent layperson possessing
6464 an average knowledge of medicine and health to believe that the
6565 individual's condition, sickness, or injury is of such a nature
6666 that failure to get immediate medical care could:
6767 (A) place the individual's health in serious
6868 jeopardy;
6969 (B) result in serious impairment to bodily
7070 functions;
7171 (C) result in serious dysfunction of a bodily
7272 organ or part;
7373 (D) result in serious disfigurement; or
7474 (E) for a pregnant woman, result in serious
7575 jeopardy to the health of the fetus.
7676 SECTION 6. Subchapter A, Chapter 4201, Insurance Code, is
7777 amended by adding Section 4201.005 to read as follows:
7878 Sec. 4201.005. EMERGENCY SERVICE DETERMINATIONS. Nothing
7979 in this subchapter prohibits a payor from considering diagnosis
8080 codes to detect fraud or abuse.
8181 SECTION 7. The changes in law made by this Act apply only to
8282 a health benefit plan delivered, issued for delivery, or renewed on
8383 or after January 1, 2024. A health benefit plan delivered, issued
8484 for delivery, or renewed before January 1, 2024, is governed by the
8585 law as it existed immediately before the effective date of this Act,
8686 and that law is continued in effect for that purpose.
8787 SECTION 8. This Act takes effect September 1, 2023.
