55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of social workers for the Homes for
88 Texas Heroes home loan program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 2306.5621(a), Government Code, is
1111 amended by amending Subdivision (2) and adding Subdivision (15-a)
1212 to read as follows:
1313 (2) "Home" means a dwelling in this state in which a
1414 fire fighter, corrections officer, county jailer, public security
1515 officer, peace officer, professional educator, social worker,
1616 veteran, or person defined as emergency medical services personnel
1717 under this section intends to reside as the borrower's principal
1818 residence.
1919 (15-a) "Social worker" has the meaning assigned by
2020 Section 505.002, Occupations Code.
2121 SECTION 2. Sections 2306.5621(b), (c), (d), (f), and (h-1),
2222 Government Code, are amended to read as follows:
2323 (b) The corporation shall establish a program to provide
2424 eligible fire fighters, corrections officers, county jailers,
2525 public security officers, peace officers, emergency medical
2626 services personnel, professional educators, social workers, and
2727 veterans with low-interest home mortgage loans.
2828 (c) To be eligible for a loan under this section, at the time
2929 a person files an application for the loan, the person must:
3030 (1) be a:
3131 (A) fire fighter, corrections officer, county
3232 jailer, public security officer, peace officer, social worker,
3333 veteran, or person defined as emergency medical services personnel
3434 under this section; or
3535 (B) professional educator who is employed by a
3636 school district or is an allied health or professional nursing
3737 program faculty member in this state;
3838 (2) reside in this state; and
3939 (3) have an income of not more than 115 percent of area
4040 median family income, adjusted for family size, or the maximum
4141 amount permitted by Section 143(f), Internal Revenue Code of 1986,
4242 whichever is greater.
4343 (d) The corporation may contract with other agencies of the
4444 state or with private entities to determine whether applicants
4545 qualify as fire fighters, corrections officers, county jailers,
4646 public security officers, peace officers, emergency medical
4747 services personnel, professional educators, social workers, or
4848 veterans under this section or otherwise to administer all or part
4949 of this section.
5050 (f) The board of directors of the corporation shall adopt
5151 rules governing:
5252 (1) the administration of the program;
5353 (2) the making of loans under the program;
5454 (3) the criteria for approving mortgage lenders;
5555 (4) the use of insurance on the loans and the homes
5656 financed under the program, as considered appropriate by the board
5757 to provide additional security for the loans;
5858 (5) the verification of occupancy of the home by the
5959 fire fighter, corrections officer, county jailer, public security
6060 officer, peace officer, professional educator, social worker,
6161 veteran, or person defined as emergency medical services personnel
6262 as the borrower's principal residence; and
6363 (6) the terms of any contract made with any mortgage
6464 lender for processing, originating, servicing, or administering
6565 the loans.
6666 (h-1) To fund home mortgage loans for eligible fire
6767 fighters, corrections officers, county jailers, public security
6868 officers, peace officers, emergency medical services personnel,
6969 professional educators, social workers, and veterans under this
7070 section, the corporation may use any proceeds received from the
7171 sale of bonds, notes, or other obligations issued under the home
7272 loan program provided by this section, regardless of any amendments
7373 to the eligibility standards for loans made under the program and
7474 regardless of when the corporation received the proceeds from those
7575 bonds, notes, or other obligations issued under the program.
7676 SECTION 3. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2023.
