66 AN ACT
77 relating to certificates of public convenience and necessity for
88 certain transmission projects.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 37.0541, Utilities Code, is amended to
1111 read as follows:
1212 Sec. 37.0541. CONSOLIDATION OF CERTAIN PROCEEDINGS. The
1313 commission shall consolidate the proceeding on an application to
1414 obtain or amend a certificate of convenience and necessity for the
1515 construction of a transmission line with the proceeding on another
1616 application to obtain or amend a certificate of convenience and
1717 necessity for the construction of a transmission line if it is
1818 apparent from the applications or a motion to intervene in either
1919 proceeding that the transmission lines that are the subject of the
2020 separate proceedings share a common point of interconnection. [This
2121 section does not apply to a proceeding on an application for a
2222 certificate of convenience and necessity for a transmission line to
2323 serve a competitive renewable energy zone as part of a plan
2424 developed by the commission under Section 39.904(g)(2).]
2525 SECTION 2. Section 37.056, Utilities Code, is amended by
2626 adding Subsections (a-1), (d-1), (d-2), and (d-3) and amending
2727 Subsection (d) to read as follows:
2828 (a-1) In this section:
2929 (1) "Interzonal" means involving more than one ERCOT
3030 load zone.
3131 (2) "Intrazonal" means involving a single ERCOT load
3232 zone.
3333 (d) The commission by rule shall establish criteria, in
3434 addition to the criteria described by Subsection (c), for granting
3535 a certificate for a transmission project that serves the ERCOT
3636 power region and[,] that is not necessary to meet state or federal
3737 reliability standards[, and that is not included in a plan
3838 developed under Section 39.904(g)].
3939 (d-1) Except as provided by Subsection (d-2), an
4040 application for a certificate described by Subsection (d) [The
4141 criteria] must include a comparison of the levelized estimated cost
4242 of the transmission project [for consumers] and the levelized
4343 estimated [congestion] cost savings and economic benefits [for
4444 consumers] that may result from the [transmission] project[,
4545 considering both current and future expected congestion levels and
4646 the transmission project's ability to reduce those congestion
4747 levels]. The commission shall include with the commission's
4848 decision to grant or deny the certificate the commission's findings
4949 on the comparison. The comparison must account for:
5050 (1) the probable improvement of service and reduction
5151 of costs for consumers that may be realized from the project;
5252 (2) an estimated value of the reduction in curtailment
5353 costs that may be realized from the project;
5454 (3) an estimation of reduced transmission losses that
5555 may be realized from the project;
5656 (4) an assessment of whether the project will provide
5757 improved access to the ERCOT power grid for new generation
5858 facilities and the benefits that improved access could provide to
5959 generation facilities, industrial load, and the ERCOT market;
6060 (5) an estimation of reduced future transmission
6161 investment costs that may be realized from the project;
6262 (6) an estimation of costs of projects described by
6363 Subsection (d-2) that may be avoided as a result of the project; and
6464 (7) an estimation of direct economic benefits that may
6565 be realized from the construction of the project [The commission
6666 shall include with its decision on an application for a certificate
6767 to which this subsection applies findings on the criteria].
6868 (d-2) If an application does not include a comparison
6969 described by Subsection (d-1), the commission may not grant a
7070 certificate for a project described by Subsection (d) unless the
7171 commission finds that the project is needed to support a reliable
7272 and adequate transmission network, to facilitate wholesale
7373 competition, or to minimize curtailments due to interzonal
7474 constraints and intrazonal congestion.
7575 (d-3) Not less than once per year, the independent
7676 organization certified under Section 39.151 for the ERCOT power
7777 region shall identify pending applications for transmission
7878 projects that will meet commission findings under Subsection (d-2).
7979 SECTION 3. Section 39.904(k), Utilities Code, is amended to
8080 read as follows:
8181 (k) The commission and the independent organization
8282 certified for ERCOT shall study the need for increased transmission
8383 and generation capacity throughout this state and report to the
8484 legislature the results of the study and any recommendations for
8585 legislation. The report must be filed with the legislature not
8686 later than December 31 of each even-numbered year [and may be filed
8787 as a part of the report required by Subsection (j)].
8888 SECTION 4. Subchapter Z, Chapter 39, Utilities Code, is
8989 amended by adding Section 39.919 to read as follows:
9090 Sec. 39.919. CRITICAL DESIGNATION TRANSMISSION
9191 INFRASTRUCTURE PROJECTS. (a) In this section:
9292 (1) "Interzonal" means involving more than one ERCOT
9393 load zone.
9494 (2) "Intrazonal" means involving a single ERCOT load
9595 zone.
9696 (b) Not later than December 30, 2023, the independent
9797 organization certified under Section 39.151 for the ERCOT power
9898 region shall:
9999 (1) identify, in consultation with the commission,
100100 critical designation transmission infrastructure projects and the
101101 transmission and distribution utilities that will construct and
102102 operate the projects in a manner consistent with Section 37.056;
103103 and
104104 (2) submit a written description of each project to
105105 the commission.
106106 (c) Projects identified under Subsection (b) must
107107 facilitate a timely and targeted expansion of the electric power
108108 grid in ERCOT for the purposes of:
109109 (1) resolving existing interzonal and intrazonal
110110 transmission constraints, congestion, or curtailments, including
111111 generic transmission constraints; and
112112 (2) ensuring the future reliability of the ERCOT
113113 electric power grid.
114114 (d) To the extent practicable, projects identified under
115115 Subsection (b) should:
116116 (1) be cost-effective and designed to transmit high
117117 volumes of electricity in and across ERCOT load zones efficiently;
118118 (2) minimize the need for the acquisition of new
119119 rights-of-way by replacing aging infrastructure or following
120120 routes that align with existing rights-of-way or existing
121121 transmission infrastructure;
122122 (3) minimize interzonal constraints and intrazonal
123123 congestion during construction activities;
124124 (4) be designed to accommodate new solutions,
125125 including higher voltages, if the independent organization
126126 determines that new solutions are required; and
127127 (5) be designed to significantly reduce present or
128128 expected future interzonal constraints and intrazonal congestion.
129129 (e) The independent organization certified under Section
130130 39.151 for the ERCOT power region shall identify as a critical
131131 designation transmission infrastructure project under Subsection
132132 (b) a project addressing an interzonal constraint or intrazonal
133133 congestion in an area if:
134134 (1) the constraint or congestion has been present for
135135 three years or longer; and
136136 (2) the area has experienced constraint or congestion
137137 costs greater than or equal to $100 million per year in each of the
138138 previous three years.
139139 (f) The independent organization certified under Section
140140 39.151 for the ERCOT power region may consult with the independent
141141 organization's market participant segments and other stakeholders
142142 to identify projects under Subsection (b) that could facilitate:
143143 (1) the growth of the economy of this state; or
144144 (2) oil and gas, commercial, and industrial
145145 development that could provide substantial new tax revenue,
146146 landowner income, or new jobs in this state.
147147 (g) Not later than the 450th day after the date that the
148148 independent organization certified under Section 39.151 for the
149149 ERCOT power region submits a written description of a project to the
150150 commission under Subsection (b), the utility that will construct
151151 and operate the project shall submit to the commission an
152152 application for a certificate of public convenience and necessity
153153 for the project.
154154 (h) In considering an application for a certificate of
155155 public convenience and necessity for a project identified under
156156 Subsection (b), the commission is not required to consider the
157157 factors provided by Sections 37.056(c)(1) and (2). The commission
158158 shall consider all factors provided by Section 37.056, including
159159 Sections 37.056(c)(1) and (2), for a project not identified under
160160 Subsection (b).
161161 (i) If the commission issues a certificate of public
162162 convenience and necessity for a project identified under Subsection
163163 (b), the commission shall find that the project is used and useful
164164 to the utility in providing service for purposes of this section,
165165 prudent, and includable in the rate base, regardless of the extent
166166 of the utility's actual use of the project.
167167 (j) Transmission service that is facilitated through a
168168 project identified under Subsection (b) must be provided in a
169169 manner consistent with Subchapter A, Chapter 35.
170170 (k) This section expires September 1, 2032.
171171 SECTION 5. Sections 39.904(g), (h), (i), and (j), Utilities
172172 Code, are repealed.
173173 SECTION 6. The changes in law made by this Act apply only to
174174 a proceeding affecting a certificate of public convenience and
175175 necessity that commences on or after the effective date of this Act.
176176 A proceeding affecting a certificate of public convenience and
177177 necessity that commenced before the effective date of this Act is
178178 governed by the law in effect on the date the proceeding is
179179 commenced, and that law is continued in effect for that purpose.
180180 SECTION 7. The recovery of a transmission facility
181181 investment made by an electric utility to serve a competitive
182182 renewable energy zone is governed by the law in effect on the date
183183 the facility is placed in service, regardless of whether the
184184 facility is completed before, on, or after the effective date of
185185 this Act, and that law is continued in effect for that purpose.
186186 SECTION 8. This Act takes effect September 1, 2023.
