| 5 | 5 | | relating to the ability of a local authority to designate school |

| 6 | 6 | | crossing zones and school crosswalks at high school campuses |

| 7 | 7 | | located in certain municipalities. |
|---|
| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 542.203, Transportation Code, is amended |
|---|
| 10 | 10 | | by adding Subsections (d) and (e) to read as follows: |
|---|
| 11 | 11 | | (d) A local authority's standards, policies, orders, |
|---|
| 12 | 12 | | ordinances, regulations, or other measures that designate a school |
|---|
| 13 | 13 | | crossing zone or school crosswalk must include a high school campus |
|---|
| 14 | 14 | | that is located in a municipality with a population of two million |
|---|
| 15 | 15 | | or more. |
|---|
| 16 | 16 | | (e) On request of an administrator of a high school campus |
|---|
| 17 | 17 | | described by Subsection (d), a local authority shall determine the |
|---|
| 18 | 18 | | components, including any engineering report, necessary to |
|---|
| 19 | 19 | | designate a school crossing zone or school crosswalk at the campus |
|---|
| 20 | 20 | | and shall make the designation. This subsection does not apply to a |
|---|
| 21 | 21 | | high school campus undergoing major expansion or new construction |
|---|
| 22 | 22 | | that requires the preparation of a traffic impact analysis as part |
|---|
| 23 | 23 | | of the permitting process. |
|---|
| 24 | 24 | | SECTION 2. Not later than September 1, 2023, a local |
|---|
| 25 | 25 | | authority described by Section 542.203(d), Transportation Code, as |
|---|
| 26 | 26 | | added by this Act, shall: |
|---|
| 27 | 27 | | (1) update all applicable school zone standards, |
|---|
| 28 | 28 | | policies, orders, ordinances, and regulations to comply with that |
|---|
| 29 | 29 | | section; and |
|---|
| 30 | 30 | | (2) post the updates described by Subdivision (1) of |
|---|
| 31 | 31 | | this section on a publicly accessible Internet website with clear |
|---|
| 32 | 32 | | instructions describing the process by which a designation request |
|---|
| 33 | 33 | | may be made under Section 542.203(e), Transportation Code, as added |
|---|
| 34 | 34 | | by this Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect September 1, 2023. |
