| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter D, Chapter 38, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 38.0761 to read as follows: |
|---|
| 12 | 12 | | Sec. 38.0761. DESIGNATION OF TRANSMISSION OPERATORS BY |
|---|
| 13 | 13 | | CERTAIN MUNICIPALLY OWNED UTILITIES. A municipally owned utility |
|---|
| 14 | 14 | | is not required to designate a transmission operator for compliance |
|---|
| 15 | 15 | | with load shedding duties and related obligations established by |
|---|
| 16 | 16 | | the independent organization certified under Section 39.151 for the |
|---|
| 17 | 17 | | ERCOT power region if the municipally owned utility: |
|---|
| 18 | 18 | | (1) is owned by a municipality with a population of |
|---|
| 19 | 19 | | less than 25,000; |
|---|
| 20 | 20 | | (2) has an annual peak demand of 25 megawatts or less; |
|---|
| 21 | 21 | | and |
|---|
| 22 | 22 | | (3) operates 10 or fewer distribution feeder circuits. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
