| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 102.051, Business & Commerce Code, is |
|---|
| 10 | 10 | | amended to read as follows: |
|---|
| 11 | 11 | | Sec. 102.051. DEFINITIONS. In this subchapter: |
|---|
| 12 | 12 | | (1) "Drag performance" has the meaning assigned by |
|---|
| 13 | 13 | | Section 243.002, Local Government Code. |
|---|
| 14 | 14 | | (1-a) "Nude" means: |
|---|
| 15 | 15 | | (A) entirely unclothed; or |
|---|
| 16 | 16 | | (B) clothed in a manner that leaves uncovered or |
|---|
| 17 | 17 | | visible through less than fully opaque clothing any portion of the |
|---|
| 18 | 18 | | breasts below the top of the areola of the breasts, if the person is |
|---|
| 19 | 19 | | female, or any portion of the genitals or buttocks. |
|---|
| 20 | 20 | | (2) "Sexually oriented business" means a nightclub, |
|---|
| 21 | 21 | | bar, restaurant, or similar commercial enterprise that: |
|---|
| 22 | 22 | | (A) provides for an audience of two or more |
|---|
| 23 | 23 | | individuals: |
|---|
| 24 | 24 | | (i) live nude entertainment or live nude |
|---|
| 25 | 25 | | performances; or |
|---|
| 26 | 26 | | (ii) a drag performance; and |
|---|
| 27 | 27 | | (B) authorizes on-premises consumption of |
|---|
| 28 | 28 | | alcoholic beverages, regardless of whether the consumption of |
|---|
| 29 | 29 | | alcoholic beverages is under a license or permit issued under the |
|---|
| 30 | 30 | | Alcoholic Beverage Code. |
|---|
| 31 | 31 | | SECTION 2. Section 243.002, Local Government Code, is |
|---|
| 32 | 32 | | amended to read as follows: |
|---|
| 33 | 33 | | Sec. 243.002. DEFINITIONS [DEFINITION]. In this chapter: |
|---|
| 34 | 34 | | (1) "Drag performance" means a performance in which a |
|---|
| 35 | 35 | | performer exhibits a gender identity that is different than the |
|---|
| 36 | 36 | | performer's gender assigned at birth using clothing, makeup, or |
|---|
| 37 | 37 | | other physical markers and sings, lip syncs, dances, or otherwise |
|---|
| 38 | 38 | | performs before an audience for entertainment. |
|---|
| 39 | 39 | | (2) "Sexually [, "sexually] oriented business" means: |
|---|
| 40 | 40 | | (A) a sex parlor, nude studio, modeling studio, |
|---|
| 41 | 41 | | love parlor, adult bookstore, adult movie theater, adult video |
|---|
| 42 | 42 | | arcade, adult movie arcade, adult video store, adult motel, or |
|---|
| 43 | 43 | | other commercial enterprise the primary business of which is the |
|---|
| 44 | 44 | | offering of a service or the selling, renting, or exhibiting of |
|---|
| 45 | 45 | | devices or any other items intended to provide sexual stimulation |
|---|
| 46 | 46 | | or sexual gratification to the customer; or |
|---|
| 47 | 47 | | (B) a nightclub, bar, restaurant, or other |
|---|
| 48 | 48 | | commercial enterprise that provides for an audience of two or more |
|---|
| 49 | 49 | | individuals a drag performance. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect September 1, 2023. |
