| 7 | 7 | | driver's licenses are surrendered. |

| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 521.101, Transportation Code, is amended |
|---|
| 10 | 10 | | by adding Subsection (n) to read as follows: |
|---|
| 11 | 11 | | (n) The department shall adopt procedures to allow a person |
|---|
| 12 | 12 | | who is 65 years of age or older and possesses a driver's license |
|---|
| 13 | 13 | | that is compliant with the federal REAL ID program to apply for a |
|---|
| 14 | 14 | | personal identification certificate online or by phone if the |
|---|
| 15 | 15 | | person surrenders the person's driver's license in a manner |
|---|
| 16 | 16 | | prescribed by the department. The procedures: |
|---|
| 17 | 17 | | (1) must be in compliance with federal guidelines |
|---|
| 18 | 18 | | governing the issuance of identity documents; and |
|---|
| 19 | 19 | | (2) may require the person issued a personal |
|---|
| 20 | 20 | | identification certificate to update information previously |
|---|
| 21 | 21 | | provided to the department under Section 521.142. |

| 22 | 22 | | SECTION 2. This Act takes effect September 1, 2023. |
