44 AN ACT
55 relating to pedestrian use of a sidewalk.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Section 552.006(b), Transportation Code, is
88 amended to read as follows:
99 (b) If a sidewalk is not provided, a pedestrian walking
1010 along and on a highway shall [if possible] walk on [:
1111 [(1)] the left side of the roadway [;] or
1212 [(2)] the shoulder of the highway facing oncoming
1313 traffic, unless the left side of the roadway or the shoulder of the
1414 highway facing oncoming traffic is obstructed or unsafe.
1515 SECTION 2. The change in law made by this Act applies only
1616 to an offense committed on or after the effective date of this Act.
1717 An offense committed before the effective date of this Act is
1818 governed by the law in effect on the date the offense was committed,
1919 and the former law is continued in effect for that purpose. For
2020 purposes of this section, an offense was committed before the
2121 effective date of this Act if any element of the offense occurred
2222 before that date.
2323 SECTION 3. This Act takes effect September 1, 2023.
