| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subtitle A, Title 9, Health and Safety Code, is |
|---|
| 11 | 11 | | amended by adding Chapter 769 to read as follows: |
|---|
| 12 | 12 | | CHAPTER 769. RECREATIONAL VEHICLE PARK AND CAMPGROUND CONSTRUCTION |

| 13 | 13 | | STANDARDS |
|---|
| 14 | 14 | | Sec. 769.001. DEFINITION. In this chapter, "governmental |
|---|
| 15 | 15 | | entity" means this state or a state agency or political subdivision |
|---|
| 16 | 16 | | of this state. |
|---|
| 17 | 17 | | Sec. 769.002. APPLICABILITY. This chapter applies only to |
|---|
| 18 | 18 | | a recreational vehicle park or campground consisting of a privately |
|---|
| 19 | 19 | | owned parcel or tract of land under the control of a person or |
|---|
| 20 | 20 | | entity, other than a governmental entity, on which sites for |
|---|
| 21 | 21 | | recreational vehicles, recreational park trailers, or other |
|---|
| 22 | 22 | | camping units are offered primarily for transient guest use by |
|---|
| 23 | 23 | | members of the public or an organization for overnight stays. |
|---|
| 24 | 24 | | Sec. 769.003. MINIMUM STANDARDS. A recreational vehicle |
|---|
| 25 | 25 | | park or campground to which this chapter applies must comply with |
|---|
| 26 | 26 | | the National Fire Protection Association 1194, Standard for |
|---|
| 27 | 27 | | Recreational Vehicle Parks and Campgrounds, other than Section |
|---|
| 28 | 28 | | 1.1.1. |
|---|
| 29 | 29 | | Sec. 769.004. EFFECT OF OTHER LAW. A governmental entity |
|---|
| 30 | 30 | | may adopt a policy, rule, ordinance, or order that regulates |
|---|
| 31 | 31 | | environmental health and sanitation, electrical distribution |
|---|
| 32 | 32 | | system safety, liquefied petroleum gas storage and dispensing |
|---|
| 33 | 33 | | safety, or fire protection only if the policy, rule, ordinance, or |
|---|
| 34 | 34 | | order does not impose standards more stringent than the standards |
|---|
| 35 | 35 | | imposed under Section 769.003. |
|---|
| 36 | 36 | | SECTION 2. Notwithstanding Chapter 769, Health and Safety |
|---|
| 37 | 37 | | Code, as added by this Act, a recreational vehicle park or |
|---|
| 38 | 38 | | campground to which that chapter applies operating on the effective |
|---|
| 39 | 39 | | date of this Act is not required to comply with that chapter before |
|---|
| 40 | 40 | | September 1, 2024. |
|---|
| 41 | 41 | | SECTION 3. This Act takes effect September 1, 2023. |
