77 relating to construction standards for certain recreational
88 vehicle parks and campgrounds.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 9, Health and Safety Code, is
1111 amended by adding Chapter 769 to read as follows:
1212 CHAPTER 769. RECREATIONAL VEHICLE PARK AND CAMPGROUND CONSTRUCTION
1313 STANDARDS
1414 Sec. 769.001. DEFINITION. In this chapter, "governmental
1515 entity" means this state or a state agency or political subdivision
1616 of this state.
1717 Sec. 769.002. APPLICABILITY. This chapter applies only to
1818 a recreational vehicle park or campground consisting of a privately
1919 owned parcel or tract of land under the control of a person or
2020 entity, other than a governmental entity, on which sites for
2121 recreational vehicles, recreational park trailers, or other
2222 camping units are offered primarily for transient guest use by
2323 members of the public or an organization for overnight stays.
2424 Sec. 769.003. MINIMUM STANDARDS. A recreational vehicle
2525 park or campground to which this chapter applies must comply with
2626 the National Fire Protection Association 1194, Standard for
2727 Recreational Vehicle Parks and Campgrounds, other than Section
2828 1.1.1.
2929 Sec. 769.004. EFFECT OF OTHER LAW. A governmental entity
3030 may adopt a policy, rule, ordinance, or order that regulates
3131 environmental health and sanitation, electrical distribution
3232 system safety, liquefied petroleum gas storage and dispensing
3333 safety, or fire protection only if the policy, rule, ordinance, or
3434 order does not impose standards more stringent than the standards
3535 imposed under Section 769.003.
3636 SECTION 2. Notwithstanding Chapter 769, Health and Safety
3737 Code, as added by this Act, a recreational vehicle park or
3838 campground to which that chapter applies operating on the effective
3939 date of this Act is not required to comply with that chapter before
4040 September 1, 2024.
4141 SECTION 3. This Act takes effect September 1, 2023.
