77 relating to access to mobile showers by homeless individuals in
88 certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 11, Local Government Code, is
1111 amended by adding Chapter 350 to read as follows:
1212 CHAPTER 350. MISCELLANEOUS PROVISIONS RELATING TO MUNICIPAL HEALTH
1313 AND PUBLIC SAFETY
1414 Sec. 350.001. ACCESS TO MOBILE SHOWERS BY HOMELESS IN
1515 CERTAIN MUNICIPALITIES. (a) A municipality with a population of
1616 500,000 or more shall provide to homeless individuals residing in
1717 the municipality access to mobile showers. The municipality must
1818 make available a sufficient number of showers to allow daily shower
1919 access by each homeless individual residing in the municipality.
2020 The municipality shall ensure that the access is sufficient to
2121 address the hygienic needs of and the prevention of hygiene-related
2222 illnesses in the municipality's homeless population.
2323 (b) A municipality subject to Subsection (a) shall use all
2424 available federal money, including money provided under the
2525 American Rescue Plan Act of 2021 (Pub. L. No. 117-2), that is
2626 available for implementing that subsection.
2727 SECTION 2. This Act takes effect September 1, 2023.
