66 AN ACT
77 relating to electronic voter registration.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1010 amended by adding Section 13.009 to read as follows:
1111 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1212 secretary of state shall implement a program to allow a person to
1313 complete a voter registration application over the Internet from
1414 the official website of this state. The Internet websites of the
1515 secretary of state and the Department of Public Safety must also
1616 provide a link to the location of the application on the official
1717 website of this state.
1818 (b) An applicant for electronic voter registration who has
1919 an unexpired driver's license or personal identification card
2020 issued in this state must:
2121 (1) attest to the truth of the information provided on
2222 the application by affirmatively accepting the information as true;
2323 and
2424 (2) affirmatively consent to the use of the signature
2525 on the applicant's driver's license or personal identification card
2626 for voter registration purposes.
2727 (c) An applicant for electronic voter registration who does
2828 not have an unexpired driver's license or personal identification
2929 card issued in this state must:
3030 (1) attest to the truth of the information provided on
3131 the application by affirmatively accepting the information as true;
3232 and
3333 (2) print a registration application from the website
3434 the applicant is using to register, sign the application, and mail
3535 it to the registrar.
3636 (d) For each application submitted under Subsection (b),
3737 the program shall require that a digital copy of the applicant's
3838 signature be obtained from the Department of Public Safety.
3939 (e) For each application submitted under Subsection (c),
4040 the program shall provide the applicant with:
4141 (1) a registration application that the applicant can
4242 print from the registration website, sign, and mail to the
4343 registrar as required under Subsection (c)(2); and
4444 (2) information about how the applicant can obtain a
4545 driver's license or personal identification card from the
4646 Department of Public Safety.
4747 (f) An application submitted under this section is
4848 considered for all purposes an application submitted by mail under
4949 this title.
5050 (g) The secretary of state shall adopt rules as necessary to
5151 implement this section, including rules to provide for additional
5252 security measures necessary to ensure the accuracy and integrity of
5353 applications submitted electronically.
5454 (h) The rules adopted under Subsection (g) must require
5555 that:
5656 (1) the Internet website through which a person may
5757 complete a voter registration application include a description of
5858 the offense described by Section 13.007 in a conspicuous location
5959 on the website near the place where the person begins or submits the
6060 application; and
6161 (2) the state electronic Internet portal project be
6262 used to authenticate the identity of a person who submits an
6363 application electronically under this section.
6464 SECTION 2. This Act takes effect September 1, 2023.
