| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 81.01004, Natural Resources Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | Sec. 81.01004. PERSONAL FINANCIAL DISCLOSURE, STANDARDS OF |
|---|
| 13 | 13 | | CONDUCT, [AND] CONFLICT OF INTEREST, AND RECUSAL. (a) A |
|---|
| 14 | 14 | | commissioner is subject to the provisions of Chapter 572, |
|---|
| 15 | 15 | | Government Code, that apply to elected officers, including the |
|---|
| 16 | 16 | | requirements governing personal financial statements, standards of |
|---|
| 17 | 17 | | conduct, and conflicts of interest. |
|---|
| 18 | 18 | | (b) Notwithstanding any other provision of law, a |
|---|
| 19 | 19 | | commissioner may not act on a matter under the commission's |
|---|
| 20 | 20 | | consideration that involves a business entity, as defined by |
|---|
| 21 | 21 | | Section 572.002, Government Code: |
|---|
| 22 | 22 | | (1) in which the commissioner has an equity ownership |
|---|
| 23 | 23 | | interest; |
|---|
| 24 | 24 | | (2) from which the commissioner receives income; or |
|---|
| 25 | 25 | | (3) with which the commissioner has otherwise done |
|---|
| 26 | 26 | | business in the preceding year in an amount of more than $5,000, |
|---|
| 27 | 27 | | including the making of consumer purchases. |
|---|
| 28 | 28 | | SECTION 2. This Act takes effect September 1, 2023. |
