77 relating to the recusal of a member of the Railroad Commission of
88 Texas in certain matters.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 81.01004, Natural Resources Code, is
1111 amended to read as follows:
1212 Sec. 81.01004. PERSONAL FINANCIAL DISCLOSURE, STANDARDS OF
1313 CONDUCT, [AND] CONFLICT OF INTEREST, AND RECUSAL. (a) A
1414 commissioner is subject to the provisions of Chapter 572,
1515 Government Code, that apply to elected officers, including the
1616 requirements governing personal financial statements, standards of
1717 conduct, and conflicts of interest.
1818 (b) Notwithstanding any other provision of law, a
1919 commissioner may not act on a matter under the commission's
2020 consideration that involves a business entity, as defined by
2121 Section 572.002, Government Code:
2222 (1) in which the commissioner has an equity ownership
2323 interest;
2424 (2) from which the commissioner receives income; or
2525 (3) with which the commissioner has otherwise done
2626 business in the preceding year in an amount of more than $5,000,
2727 including the making of consumer purchases.
2828 SECTION 2. This Act takes effect September 1, 2023.
