55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to menstrual disorders education and informational
88 materials for public school students.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 28, Education Code, is
1111 amended by adding Section 28.0044 to read as follows:
1212 Sec. 28.0044. MENSTRUAL DISORDERS EDUCATION AND
1313 INFORMATIONAL MATERIALS. (a) In this section, "age-appropriate"
1414 means suitable to particular ages or age groups of children or
1515 adolescents, based on developing cognitive, emotional, and
1616 behavioral capacity typical for the age or age group.
1717 (b) A school district may provide to students education and
1818 informational materials regarding menstrual disorders at grade
1919 levels and in courses considered appropriate by the district.
2020 (c) The State Board of Education by rule shall adopt a list
2121 of age-appropriate informational materials regarding menstrual
2222 disorders and symptoms of menstrual disorders. The materials must
2323 include information on:
2424 (1) the timing, signs, and symptoms of endometriosis
2525 and other menstrual disorders;
2626 (2) the importance of menstrual health and the impact
2727 of menstrual health on a person's physical and emotional
2828 well-being, social interactions, and academic performance;
2929 (3) basic statistics on endometriosis and other
3030 menstrual disorders;
3131 (4) best practices regarding methods to advocate for
3232 one's own health care; and
3333 (5) basic treatment options for endometriosis and
3434 other menstrual disorders and recommendations for follow-up care
3535 from a health care provider.
3636 (d) The State Board of Education shall make available to a
3737 school district on request any informational materials included on
3838 the list adopted under Subsection (c).
3939 SECTION 2. This Act applies beginning with the 2023-2024
4040 school year.
4141 SECTION 3. This Act takes effect immediately if it receives
4242 a vote of two-thirds of all the members elected to each house, as
4343 provided by Section 39, Article III, Texas Constitution. If this
4444 Act does not receive the vote necessary for immediate effect, this
4545 Act takes effect September 1, 2023.
