| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Section 66.002(10), Utilities Code, is amended |
|---|
| 10 | 10 | | to read as follows: |
|---|
| 11 | 11 | | (10) "Video service" means video programming services |
|---|
| 12 | 12 | | provided by a video service provider through wireline facilities |
|---|
| 13 | 13 | | located at least in part in the public right-of-way without regard |
|---|
| 14 | 14 | | to delivery technology, including Internet protocol technology. |
|---|
| 15 | 15 | | The term [This definition] does not include: |
|---|
| 16 | 16 | | (A) [any] video service provided by a commercial |
|---|
| 17 | 17 | | mobile service provider as defined in 47 U.S.C. Section 332(d); |
|---|
| 18 | 18 | | (B) direct-to-home satellite services, as |
|---|
| 19 | 19 | | defined in 47 U.S.C. Section 303(v); or |
|---|
| 20 | 20 | | (C) any video programming accessed via a service |
|---|
| 21 | 21 | | that enables users to access content, information, electronic mail, |
|---|
| 22 | 22 | | or other services offered over the Internet, including streaming |
|---|
| 23 | 23 | | content. |
|---|
| 24 | 24 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 25 | 25 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 26 | 26 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 27 | 27 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 28 | 28 | | Act takes effect September 1, 2023. |
