55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to entities that provide video services.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 66.002(10), Utilities Code, is amended
1010 to read as follows:
1111 (10) "Video service" means video programming services
1212 provided by a video service provider through wireline facilities
1313 located at least in part in the public right-of-way without regard
1414 to delivery technology, including Internet protocol technology.
1515 The term [This definition] does not include:
1616 (A) [any] video service provided by a commercial
1717 mobile service provider as defined in 47 U.S.C. Section 332(d);
1818 (B) direct-to-home satellite services, as
1919 defined in 47 U.S.C. Section 303(v); or
2020 (C) any video programming accessed via a service
2121 that enables users to access content, information, electronic mail,
2222 or other services offered over the Internet, including streaming
2323 content.
2424 SECTION 2. This Act takes effect immediately if it receives
2525 a vote of two-thirds of all the members elected to each house, as
2626 provided by Section 39, Article III, Texas Constitution. If this
2727 Act does not receive the vote necessary for immediate effect, this
2828 Act takes effect September 1, 2023.
