77 relating to the basic allotment and guaranteed yield under the
88 public school finance system.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter F, Chapter 48, Education Code, is
1111 amended by adding Section 48.2511 to read as follows:
1212 Sec. 48.2511. APPROPRIATION FOR PUBLIC EDUCATION. In each
1313 biennial General Appropriations Act, the legislature shall set the
1414 basic allotment under Section 48.051 and the dollar amount
1515 guaranteed level of state and local funds per weighted student per
1616 cent of tax effort ("GL") under Section 48.202 for each state fiscal
1717 year at:
1818 (1) the amounts necessary for the amount of state
1919 funds to which all school districts are jointly entitled under this
2020 chapter, together with state funds to which all school districts
2121 are jointly entitled for that state fiscal year under any other law
2222 that provides funding for the general maintenance and operation of
2323 the system of public free schools, to comply with the minimum
2424 requirement of Section 1, Article VII, Texas Constitution; or
2525 (2) amounts greater than the amounts specified by
2626 Subdivision (1).
2727 SECTION 2. This Act takes effect September 1, 2024, but only
2828 if the constitutional amendment proposed by the 88th Legislature,
2929 Regular Session, 2023, requiring the state to pay at least 50
3030 percent of the cost of maintaining and operating the public school
3131 system and prohibiting the comptroller from certifying legislation
3232 containing an appropriation for public education unless the
3333 requirement is met, is approved by the voters. If that amendment is
3434 not approved by the voters, this Act has no effect.
