| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter F, Chapter 48, Education Code, is |
|---|
| 11 | 11 | | amended by adding Section 48.2511 to read as follows: |
|---|
| 12 | 12 | | Sec. 48.2511. APPROPRIATION FOR PUBLIC EDUCATION. In each |
|---|
| 13 | 13 | | biennial General Appropriations Act, the legislature shall set the |
|---|
| 14 | 14 | | basic allotment under Section 48.051 and the dollar amount |
|---|
| 15 | 15 | | guaranteed level of state and local funds per weighted student per |
|---|
| 16 | 16 | | cent of tax effort ("GL") under Section 48.202 for each state fiscal |
|---|
| 17 | 17 | | year at: |
|---|
| 18 | 18 | | (1) the amounts necessary for the amount of state |
|---|
| 19 | 19 | | funds to which all school districts are jointly entitled under this |
|---|
| 20 | 20 | | chapter, together with state funds to which all school districts |
|---|
| 21 | 21 | | are jointly entitled for that state fiscal year under any other law |
|---|
| 22 | 22 | | that provides funding for the general maintenance and operation of |
|---|
| 23 | 23 | | the system of public free schools, to comply with the minimum |
|---|
| 24 | 24 | | requirement of Section 1, Article VII, Texas Constitution; or |
|---|
| 25 | 25 | | (2) amounts greater than the amounts specified by |
|---|
| 26 | 26 | | Subdivision (1). |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect September 1, 2024, but only |
|---|
| 28 | 28 | | if the constitutional amendment proposed by the 88th Legislature, |
|---|
| 29 | 29 | | Regular Session, 2023, requiring the state to pay at least 50 |
|---|
| 30 | 30 | | percent of the cost of maintaining and operating the public school |
|---|
| 31 | 31 | | system and prohibiting the comptroller from certifying legislation |
|---|
| 32 | 32 | | containing an appropriation for public education unless the |
|---|
| 33 | 33 | | requirement is met, is approved by the voters. If that amendment is |
|---|
| 34 | 34 | | not approved by the voters, this Act has no effect. |
