55 AN ACT
66 relating to detention orders in a juvenile court proceeding.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 54.01(h), Family Code, is amended to
99 read as follows:
1010 (h) A detention order extends to the conclusion of the
1111 disposition hearing, if there is one, but in no event for more than
1212 2 [10] working days. Further detention orders may be made following
1313 subsequent detention hearings. The initial detention hearing may
1414 not be waived but subsequent detention hearings may be waived in
1515 accordance with the requirements of Section 51.09. Each subsequent
1616 detention order shall extend for no more than 2 [10] working days,
1717 except that in a county that does not have a certified juvenile
1818 detention facility, as described by Section 51.12(a)(3), each
1919 subsequent detention order shall extend for no more than 10 [15]
2020 working days.
2121 SECTION 2. The change in law made by this Act applies to a
2222 juvenile court proceeding that began, on or after the effective
2323 date of this Act. A juvenile court proceeding that began before
2424 that date is governed by the law in effect on the date, and the
2525 former law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2023.
