55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the prosecution and punishment of certain criminal
88 offenses involving the smuggling of persons or the operation of a
99 stash house; increasing criminal penalties.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Sections 20.05(a), (b), and (c), Penal Code, are
1212 amended to read as follows:
1313 (a) A person commits an offense if the person knowingly:
1414 (1) uses a motor vehicle, aircraft, watercraft, or
1515 other means of conveyance to transport an individual with the
1616 intent to:
1717 (A) conceal the individual from a peace officer
1818 or special investigator; or
1919 (B) flee from a person the actor knows is a peace
2020 officer or special investigator attempting to lawfully arrest or
2121 detain the actor;
2222 (2) encourages or induces a person to enter or remain
2323 in this country in violation of federal law by concealing,
2424 harboring, or shielding that person from detection; or
2525 (3) assists, guides, or directs two or more
2626 individuals to enter or remain:
2727 (A) in this country in violation of federal law;
2828 or
2929 (B) on agricultural land without the effective
3030 consent of the owner.
3131 (b) An offense under this section is a felony of the first
3232 [third] degree[, except that the offense is:
3333 [(1) a felony of the second degree if:
3434 [(A) the actor commits the offense in a manner
3535 that creates a substantial likelihood that the smuggled individual
3636 will suffer serious bodily injury or death;
3737 [(B) the smuggled individual is a child younger
3838 than 18 years of age at the time of the offense;
3939 [(C) the offense was committed with the intent to
4040 obtain a pecuniary benefit;
4141 [(D) during the commission of the offense the
4242 actor, another party to the offense, or an individual assisted,
4343 guided, or directed by the actor knowingly possessed a firearm; or
4444 [(E) the actor commits the offense under
4545 Subsection (a)(1)(B); or
4646 [(2) a felony of the first degree if:
4747 [(A) it is shown on the trial of the offense that,
4848 as a direct result of the commission of the offense, the smuggled
4949 individual became a victim of sexual assault, as defined by Section
5050 22.011, or aggravated sexual assault, as defined by Section 22.021;
5151 or
5252 [(B) the smuggled individual suffered serious
5353 bodily injury or death].
5454 (c) It is an affirmative defense to prosecution of an
5555 offense under this section[, other than an offense punishable under
5656 Subsection (b)(1)(A) or (b)(2),] that the actor is related to the
5757 smuggled individual within the second degree of consanguinity or,
5858 at the time of the offense, within the second degree of affinity.
5959 The affirmative defense provided by this subsection is not
6060 available if:
6161 (1) as a direct result of the commission of the
6262 offense, the smuggled individual became a victim of sexual assault,
6363 as defined by Section 22.011, or aggravated sexual assault, as
6464 defined by Section 22.021;
6565 (2) the smuggled individual suffered serious bodily
6666 injury or death; or
6767 (3) the actor committed the offense in a manner that
6868 created a substantial likelihood that the smuggled individual would
6969 suffer serious bodily injury or death.
7070 SECTION 2. Sections 20.06(e) and (f), Penal Code, are
7171 amended to read as follows:
7272 (e) Except as provided by Subsections (f) and (g), an
7373 offense under this section is a felony of the first [second] degree
7474 punishable by imprisonment in the Texas Department of Criminal
7575 Justice for life or for any term of not more than 99 years or less
7676 than 15 years.
7777 (f) An offense under this section is a felony of the first
7878 degree, punishable by imprisonment in the Texas Department of
7979 Criminal Justice for life or for any term of not more than 99 years
8080 or less than 20 years, if:
8181 (1) the conduct constituting an offense under Section
8282 20.05 is conducted in a manner that creates a substantial
8383 likelihood that the smuggled individual will suffer serious bodily
8484 injury or death; or
8585 (2) the smuggled individual is a child younger than 18
8686 years of age at the time of the offense.
8787 SECTION 3. Section 20.07(b), Penal Code, is amended to read
8888 as follows:
8989 (b) An offense under this section is a felony of the first
9090 degree [Class A misdemeanor].
9191 SECTION 4. Sections 71.02(a) and (b), Penal Code, are
9292 amended to read as follows:
9393 (a) A person commits an offense if, with the intent to
9494 establish, maintain, or participate in a combination or in the
9595 profits of a combination or as a member of a criminal street gang,
9696 the person commits or conspires to commit one or more of the
9797 following:
9898 (1) murder, capital murder, arson, aggravated
9999 robbery, robbery, burglary, theft, aggravated kidnapping,
100100 kidnapping, aggravated assault, aggravated sexual assault, sexual
101101 assault, continuous sexual abuse of young child or disabled
102102 individual, solicitation of a minor, forgery, deadly conduct,
103103 assault punishable as a Class A misdemeanor, burglary of a motor
104104 vehicle, or unauthorized use of a motor vehicle;
105105 (2) any gambling offense punishable as a Class A
106106 misdemeanor;
107107 (3) promotion of prostitution, aggravated promotion
108108 of prostitution, or compelling prostitution;
109109 (4) unlawful manufacture, transportation, repair, or
110110 sale of firearms or prohibited weapons;
111111 (5) unlawful manufacture, delivery, dispensation, or
112112 distribution of a controlled substance or dangerous drug, or
113113 unlawful possession of a controlled substance or dangerous drug
114114 through forgery, fraud, misrepresentation, or deception;
115115 (5-a) causing the unlawful delivery, dispensation, or
116116 distribution of a controlled substance or dangerous drug in
117117 violation of Subtitle B, Title 3, Occupations Code;
118118 (6) any unlawful wholesale promotion or possession of
119119 any obscene material or obscene device with the intent to wholesale
120120 promote the same;
121121 (7) any offense under Subchapter B, Chapter 43,
122122 depicting or involving conduct by or directed toward a child
123123 younger than 18 years of age;
124124 (8) any felony offense under Chapter 32;
125125 (9) any offense under Chapter 36;
126126 (10) any offense under Chapter 34, 35, or 35A;
127127 (11) any offense under Section 37.11(a);
128128 (12) any offense under Chapter 20A;
129129 (13) any offense under Section 37.10;
130130 (14) any offense under Section 38.06, 38.07, 38.09, or
131131 38.11;
132132 (15) any offense under Section 42.10;
133133 (16) any offense under Section 46.06(a)(1) or 46.14;
134134 (17) any offense under Section 20.05, [or] 20.06, or
135135 20.07;
136136 (18) any offense under Section 16.02; or
137137 (19) any offense classified as a felony under the Tax
138138 Code.
139139 (b) Except as provided in Subsections (c) and (d), an
140140 offense under this section is one category higher than the most
141141 serious offense listed in Subsection (a) that was committed, and if
142142 the most serious offense is a Class A misdemeanor, the offense is a
143143 state jail felony, except that the offense is a felony of the first
144144 degree punishable by imprisonment in the Texas Department of
145145 Criminal Justice for:
146146 (1) life without parole, if the most serious offense
147147 is an aggravated sexual assault and if at the time of that offense
148148 the defendant is 18 years of age or older and:
149149 (A) the victim of the offense is younger than six
150150 years of age;
151151 (B) the victim of the offense is younger than 14
152152 years of age and the actor commits the offense in a manner described
153153 by Section 22.021(a)(2)(A); or
154154 (C) the victim of the offense is younger than 17
155155 years of age and suffered serious bodily injury as a result of the
156156 offense;
157157 (2) life or for any term of not more than 99 years or
158158 less than 30 years if the most serious offense is an offense under
159159 Section 20.06 that is punishable under Subsection (g) of that
160160 section; [or]
161161 (3) life or for any term of not more than 99 years or
162162 less than 25 years if the most serious offense is an offense under:
163163 (A) Section 20.05 or 20.07; or
164164 (B) Section 20.06, other than an offense that is
165165 punishable under Subsection (g) of that section; or
166166 (4) life or for any term of not more than 99 years or
167167 less than 15 years if the most serious offense is an offense
168168 punishable as a felony of the first degree, other than an offense
169169 described by Subdivision (1), [or] (2), or (3).
170170 SECTION 5. The changes in law made by this Act apply only to
171171 an offense committed on or after the effective date of this Act. An
172172 offense committed before the effective date of this Act is governed
173173 by the law in effect on the date the offense was committed, and the
174174 former law is continued in effect for that purpose. For purposes of
175175 this section, an offense was committed before the effective date of
176176 this Act if any element of the offense was committed before that
177177 date.
178178 SECTION 6. This Act takes effect September 1, 2023.
