66 relating to the regulation of brine mining wells.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 27.036, Water Code, is amended to read as
99 follows:
1010 Sec. 27.036. JURISDICTION OVER BRINE MINING. (a) In this
1111 section:
1212 (1) "Brine mining" means the production of brine,
1313 including naturally occurring brine and brine extracted by the
1414 solution of a subsurface salt formation, for the purpose of
1515 extracting elements, salts, or other useful substances besides oil
1616 and gas from a subsurface formation; and
1717 (2) "Class V brine injection well" means a well that
1818 injects spent brine into the same formation from which it was
1919 withdrawn after extraction of halogens or their salts.
2020 (b) The railroad commission has jurisdiction over brine
2121 mining and may issue permits for brine production wells and
2222 injection wells used for brine mining.
2323 [(b) A person may not begin to drill an injection well to be
2424 used for brine mining unless that person has a valid permit for the
2525 well issued by the railroad commission under this chapter.]
2626 (c) The railroad commission shall adopt rules that are
2727 necessary to administer and regulate brine mining.
2828 (d) For purposes of regulation by the railroad commission,
2929 an injection well for brine mining of brine extracted by the
3030 solution of a subsurface salt formation is designated as a Class III
3131 well under the underground injection control program administered
3232 by the railroad commission.
3333 (e) If rules or regulations adopted to govern Class V brine
3434 mining injection wells under the federal Safe Drinking Water Act
3535 (42 U.S.C. Section 300f et seq.) or another federal statute allow
3636 this state to seek primary enforcement authority under the
3737 underground injection control program, the railroad commission
3838 shall seek primacy to administer and enforce the program in this
3939 state for Class V brine mining injection wells [This section takes
4040 effect September 1, 1985].
4141 (f) For purposes of regulation by the railroad commission, a
4242 Class V brine injection well is designated as a Class V well under
4343 the underground injection control program administered by the
4444 railroad commission [This section does not invalidate any permit
4545 for an injection well used for brine mining that was issued by the
4646 Texas Water Commission before the effective date of this section.
4747 Within 90 days after the effective date of this section, the
4848 Railroad Commission of Texas shall issue a substitute permit under
4949 the name and authority of the railroad commission to each person who
5050 on the effective date of this section holds a valid permit issued by
5151 the Texas Water Commission for an injection well used for brine
5252 mining].
5353 (g) A person may not begin to drill an injection well to be
5454 used for brine mining of brine extracted by the solution of a
5555 subsurface salt formation unless that person has a valid permit for
5656 the well issued by the railroad commission under this section
5757 [Application for injection well permits covering brine mining
5858 submitted to the Texas Water Commission before the effective date
5959 of this section for which permits have not been issued by the
6060 commission shall be transmitted to the railroad commission].
6161 (h) On delegation to the railroad commission of primary
6262 enforcement authority in this state over Class V brine injection
6363 wells, a person may not begin to drill an injection well to inject
6464 brine into the same formation from which it was withdrawn after
6565 extraction of halogens or their salts unless that person has a valid
6666 permit for the well issued by the railroad commission under this
6767 section.
6868 (i) This section does not invalidate any permit for an
6969 injection well used for brine mining that was issued by the
7070 commission before the delegation to the railroad commission of
7171 primary enforcement authority in this state over Class V brine
7272 injection wells. Within 90 days after the delegation of primary
7373 enforcement authority over Class V brine injection wells, the
7474 railroad commission shall issue a substitute permit under the name
7575 and authority of the railroad commission to each person who on the
7676 effective date of this section holds a valid permit issued by the
7777 commission for a Class V brine injection well.
7878 (j) Applications for Class V brine injection well permits
7979 submitted to the commission before the delegation to the railroad
8080 commission of primary enforcement authority in this state over
8181 wells that inject spent brine into the same formation from which it
8282 was withdrawn after extraction of halogens or their salts for which
8383 permits have not been issued by the commission shall be transmitted
8484 to the railroad commission.
8585 SECTION 2. The text of Section 27.036, Water Code, added by
8686 Acts 1985, 69th Legislature, Chapter 795, Section 5.013, is
8787 repealed. This repeal shall have no effect upon the text of 27.036,
8888 Water Code, added by Acts 1985, 69th Legislature, Chapter 921,
8989 Section 2.
9090 SECTION 3. This Act takes effect immediately if it receives
9191 a vote of two-thirds of all the members elected to each house, as
9292 provided by Section 39, Article III, Texas Constitution. If this
9393 Act does not receive the vote necessary for immediate effect, this
9494 Act takes effect September 1, 2023.
