7 | 7 | | relating to the study of school district property values conducted |
---|
8 | 8 | | by the comptroller of public accounts. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Section 403.302, Government Code, is amended by |
---|
11 | 11 | | amending Subsections (b) and (c) and adding Subsection (b-1) to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (b) In conducting the study, the comptroller shall |
---|
14 | 14 | | determine the taxable value of property in each school district: |
---|
15 | 15 | | (1) using, if appropriate, samples selected through |
---|
16 | 16 | | generally accepted sampling techniques; |
---|
17 | 17 | | (2) according to generally accepted standard |
---|
18 | 18 | | valuation, statistical compilation, and analysis techniques; and |
---|
19 | 19 | | (3) [ensuring that different levels of appraisal on |
---|
20 | 20 | | sold and unsold property do not adversely affect the accuracy of the |
---|
21 | 21 | | study; and |
---|
22 | 22 | | [(4)] ensuring that different levels of appraisal |
---|
23 | 23 | | resulting from protests determined under Section 41.43, Tax Code, |
---|
24 | 24 | | are appropriately adjusted in the study. |
---|
25 | 25 | | (b-1) In conducting a study to determine the values for a |
---|
26 | 26 | | tax year, the comptroller may consider a sale of property only if |
---|
27 | 27 | | the sale occurred during the preceding tax year. |
---|
28 | 28 | | (c) If after conducting the study the comptroller |
---|
29 | 29 | | determines that the local value for a school district is valid, the |
---|
30 | 30 | | local value is presumed to represent taxable value for the school |
---|
31 | 31 | | district. In the absence of that presumption, taxable value for a |
---|
32 | 32 | | school district is the state value for the school district |
---|
33 | 33 | | determined by the comptroller under Subsections (a) and (b) unless |
---|
34 | 34 | | the local value exceeds the state value, in which case the taxable |
---|
35 | 35 | | value for the school district is the district's local value. In |
---|
36 | 36 | | determining whether the local value for a school district is valid, |
---|
37 | 37 | | the comptroller shall use a margin of error that has a range, the |
---|
38 | 38 | | upper limit of which is 105 percent of the state value and the lower |
---|
39 | 39 | | limit of which is 90 percent of the state value, [does not exceed |
---|
40 | 40 | | five percent] unless the comptroller determines that the size of |
---|
41 | 41 | | the sample of properties necessary to make the determination makes |
---|
42 | 42 | | the use of such a margin of error not feasible, in which case the |
---|
43 | 43 | | comptroller may use a larger margin of error. |
---|
44 | 44 | | SECTION 2. The changes in law made by this Act apply only to |
---|
45 | 45 | | the annual study conducted under Section 403.302, Government Code, |
---|
46 | 46 | | for a tax year that begins on or after January 1, 2024. The annual |
---|
47 | 47 | | study for a tax year that begins before that date is covered by the |
---|
48 | 48 | | law in effect immediately before the effective date of this Act, and |
---|
49 | 49 | | the prior law is continued in effect for that purpose. |
---|
50 | 50 | | SECTION 3. This Act takes effect immediately if it receives |
---|
51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
---|
52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
---|
54 | 54 | | Act takes effect September 1, 2023. |
---|
