| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 552.108, Government Code, is amended by |

| 11 | 11 | | adding Subsection (d) to read as follows: |
|---|
| 12 | 12 | | (d) Information described by Subsection (a)(2) or an |
|---|
| 13 | 13 | | internal record or notation described by Subsection (b)(2) is not |
|---|
| 14 | 14 | | excepted from the requirements of Section 552.021 if each person |
|---|
| 15 | 15 | | who is the alleged or suspected perpetrator of the crime being |
|---|
| 16 | 16 | | detected, investigated, or prosecuted is deceased. |

| 17 | 17 | | SECTION 2. Section 552.108(d), Government Code, as added by |
|---|
| 18 | 18 | | this Act, applies to information, records, and notations collected, |
|---|
| 19 | 19 | | made, assembled, or maintained on, before, or after the effective |
|---|
| 20 | 20 | | date of this Act. |
|---|
| 21 | 21 | | SECTION 3. This Act takes effect September 1, 2023. |
