55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to requiring cultural inclusion curriculum as part of the
88 enrichment curriculum for public schools.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.002(a), Education Code, is amended to
1111 read as follows:
1212 (a) Each school district that offers kindergarten through
1313 grade 12 shall offer, as a required curriculum:
1414 (1) a foundation curriculum that includes:
1515 (A) English language arts;
1616 (B) mathematics;
1717 (C) science; and
1818 (D) social studies, consisting of Texas, United
1919 States, and world history, government, economics, with emphasis on
2020 the free enterprise system and its benefits, and geography; and
2121 (2) an enrichment curriculum that includes:
2222 (A) to the extent possible, languages other than
2323 English;
2424 (B) health, with emphasis on:
2525 (i) physical health, including the
2626 importance of proper nutrition and exercise;
2727 (ii) mental health, including instruction
2828 about mental health conditions, substance abuse, skills to manage
2929 emotions, establishing and maintaining positive relationships, and
3030 responsible decision-making; and
3131 (iii) suicide prevention, including
3232 recognizing suicide-related risk factors and warning signs;
3333 (C) physical education;
3434 (D) fine arts;
3535 (E) career and technology education;
3636 (F) technology applications;
3737 (G) religious literature, including the Hebrew
3838 Scriptures (Old Testament) and New Testament, and its impact on
3939 history and literature; [and]
4040 (H) personal financial literacy; and
4141 (I) cultural inclusion.
4242 SECTION 2. Subchapter A, Chapter 28, Education Code, is
4343 amended by adding Section 28.0029 to read as follows:
4444 Sec. 28.0029. CULTURAL INCLUSION CURRICULUM. (a) The State
4545 Board of Education shall develop curriculum on cultural inclusivity
4646 that a school district or open-enrollment charter school shall use
4747 in the district's or school's cultural inclusivity courses.
4848 (b) The curriculum must encourage:
4949 (1) a student's sense of self;
5050 (2) an acceptance of diversity through the
5151 identification and exploration of differences;
5252 (3) critical thinking about bias through the
5353 identification and exploration of discrimination and stereotypes;
5454 (4) empathy toward others; and
5555 (5) advocating for oneself in the face of bias.
5656 (c) In developing the curriculum under this section, the
5757 State Board of Education shall consult with the agency and
5858 appropriate stakeholders and may create a work group of volunteers
5959 to make recommendations regarding the curriculum.
6060 (d) The State Board of Education, the agency, and
6161 appropriate stakeholders shall enter into a memorandum of
6262 understanding that establishes each entity's respective
6363 responsibilities in developing cultural inclusion curriculum that
6464 reflects the cultural, linguistic, and religious diversity of
6565 society.
6666 (e) Before finalizing the curriculum developed under this
6767 section, the State Board of Education shall provide a reasonable
6868 period for public comment.
6969 (f) Subject to rules adopted by the State Board of
7070 Education, a school district or open-enrollment charter school may
7171 tailor the curriculum developed under this section as appropriate
7272 for the district's or school's community. In tailoring the
7373 instruction, the district or school shall solicit input from the
7474 State Board of Education, the agency, community members, and other
7575 interested individuals or organizations.
7676 SECTION 3. This Act applies beginning with the 2023-2024
7777 school year.
7878 SECTION 4. This Act takes effect immediately if it receives
7979 a vote of two-thirds of all the members elected to each house, as
8080 provided by Section 39, Article III, Texas Constitution. If this
8181 Act does not receive the vote necessary for immediate effect, this
8282 Act takes effect September 1, 2023.
