| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 141, Natural Resources |
|---|
| 11 | 11 | | Code, is amended by adding Section 141.004 to read as follows: |

| 12 | 12 | | Sec. 141.004. OWNERSHIP OF GEOTHERMAL ENERGY AND ASSOCIATED |
|---|
| 13 | 13 | | RESOURCES. A landowner owns the geothermal energy and associated |
|---|
| 14 | 14 | | resources below the surface of the landowner's land as real |
|---|
| 15 | 15 | | property. Subject to the provisions of this chapter, the property |
|---|
| 16 | 16 | | rights described by this section entitle the landowner and the |
|---|
| 17 | 17 | | landowner's lessee, heir, or assign to drill for and produce the |
|---|
| 18 | 18 | | geothermal energy and associated resources below the surface of the |
|---|
| 19 | 19 | | landowner's land. |

| 20 | 20 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 21 | 21 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 22 | 22 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 23 | 23 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 24 | 24 | | Act takes effect September 1, 2023. |
