55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the licensing of certain military veterans as health
88 care providers to practice in underserved areas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter C, Chapter 155, Occupations Code, is
1111 amended by adding Section 155.108 to read as follows:
1212 Sec. 155.108. LICENSE FOR MILITARY VETERAN TO PRACTICE IN
1313 CERTAIN AREAS. (a) In this section, "active duty" and "armed
1414 forces of the United States" have the meanings assigned by Section
1515 55.001.
1616 (b) The board shall issue a license to practice medicine in
1717 a location described by Subsection (d) to an applicant who:
1818 (1) is licensed in good standing as a physician in
1919 another state;
2020 (2) is a veteran of the armed forces of the United
2121 States who retired from or otherwise left military service not more
2222 than one year before the application date for a license under this
2323 section;
2424 (3) was, at the time of retiring from or leaving
2525 military service:
2626 (A) serving on active duty in this state; and
2727 (B) authorized as a physician to treat persons
2828 enlisted in the armed forces of the United States or veterans; and
2929 (4) has passed the Texas medical jurisprudence
3030 examination.
3131 (c) The board may not issue a license under this section to
3232 an applicant who:
3333 (1) was discharged or separated from the armed forces
3434 of the United States:
3535 (A) on the basis of substandard conduct; or
3636 (B) for any act of misconduct or moral or
3737 professional dereliction;
3838 (2) holds a medical license or a license to prescribe,
3939 dispense, administer, supply, or sell a controlled substance that:
4040 (A) is currently under active investigation; or
4141 (B) is or was subject to a disciplinary order or
4242 action or to denial by another jurisdiction; or
4343 (3) has been convicted of, is on deferred adjudication
4444 community supervision or deferred disposition for, or is under
4545 active investigation for the commission of:
4646 (A) a felony; or
4747 (B) a misdemeanor involving moral turpitude.
4848 (d) A physician licensed under this section may practice
4949 only in:
5050 (1) a health professional shortage area, as defined by
5151 Section 157.051; or
5252 (2) a medically underserved community, as defined by
5353 Section 487.201, Government Code.
5454 SECTION 2. Subchapter F, Chapter 301, Occupations Code, is
5555 amended by adding Section 301.262 to read as follows:
5656 Sec. 301.262. LICENSE FOR MILITARY VETERAN TO PRACTICE IN
5757 CERTAIN AREAS. (a) In this section, "active duty" and "armed
5858 forces of the United States" have the meanings assigned by Section
5959 55.001.
6060 (b) The board shall issue a license to practice nursing in a
6161 location described by Subsection (d) to an applicant who:
6262 (1) is licensed in good standing as a nurse in another
6363 state;
6464 (2) is a veteran of the armed forces of the United
6565 States who retired from or otherwise left military service not more
6666 than one year before the application date for a license under this
6767 section;
6868 (3) was, at the time of retiring from or otherwise
6969 leaving military service:
7070 (A) serving on active duty in this state; and
7171 (B) authorized as a nurse to treat persons
7272 enlisted in the armed forces of the United States or veterans; and
7373 (4) has passed the jurisprudence examination.
7474 (c) The board may not issue a license under this section to
7575 an applicant who:
7676 (1) was discharged or separated from the armed forces
7777 of the United States:
7878 (A) on the basis of substandard conduct; or
7979 (B) for any act of misconduct or moral or
8080 professional dereliction;
8181 (2) holds a nursing license or a license to prescribe,
8282 dispense, administer, supply, or sell a controlled substance that:
8383 (A) is currently under active investigation; or
8484 (B) is or was subject to a disciplinary order or
8585 action or to denial by another jurisdiction; or
8686 (3) has been convicted of, is on deferred adjudication
8787 community supervision or deferred disposition for, or is under
8888 active investigation for the commission of:
8989 (A) a felony; or
9090 (B) a misdemeanor involving moral turpitude.
9191 (d) A nurse licensed under this section may practice only
9292 in:
9393 (1) a health professional shortage area, as defined by
9494 Section 157.051; or
9595 (2) a medically underserved community, as defined by
9696 Section 487.201, Government Code.
9797 SECTION 3. This Act takes effect September 1, 2023.
