| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter A, Chapter 215, Local Government |
|---|
| 11 | 11 | | Code, is amended by adding Section 215.007 to read as follows: |
|---|
| 12 | 12 | | Sec. 215.007. VETERINARIANS. (a) In this section, |
|---|
| 13 | 13 | | "practice of veterinary medicine" and "veterinarian" have the |
|---|
| 14 | 14 | | meanings assigned by Section 801.002, Occupations Code. |
|---|
| 15 | 15 | | (b) Unless expressly authorized by law, a municipality may |
|---|
| 16 | 16 | | not adopt or enforce an ordinance, rule, or regulation that: |
|---|
| 17 | 17 | | (1) regulates the practice of veterinary medicine; or |
|---|
| 18 | 18 | | (2) prohibits a veterinarian from performing a |
|---|
| 19 | 19 | | procedure on an animal that is not prohibited under Chapter 801, |
|---|
| 20 | 20 | | Occupations Code, or other law. |
|---|
| 21 | 21 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 22 | 22 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 23 | 23 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 24 | 24 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 25 | 25 | | Act takes effect September 1, 2023. |
