| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter G, Chapter 382, Health and Safety |
|---|
| 12 | 12 | | Code, is amended by adding Section 382.221 to read as follows: |
|---|
| 13 | 13 | | Sec. 382.221. DISTRIBUTION OF LOW-INCOME VEHICLE REPAIR |
|---|
| 14 | 14 | | ASSISTANCE, RETROFIT, AND ACCELERATED VEHICLE RETIREMENT PROGRAM |
|---|
| 15 | 15 | | FUNDS. (a) This section applies only to a county that: |
|---|
| 16 | 16 | | (1) is or was a participating county; and |
|---|
| 17 | 17 | | (2) has remitted to the state fees collected for the |
|---|
| 18 | 18 | | low-income vehicle repair assistance, retrofit, and accelerated |
|---|
| 19 | 19 | | vehicle retirement program. |
|---|
| 20 | 20 | | (b) Notwithstanding Sections 382.202(g), 382.209, and |
|---|
| 21 | 21 | | 382.220, not later than January 1, 2024, the commission shall |
|---|
| 22 | 22 | | distribute to the counties described by Subsection (a) all |
|---|
| 23 | 23 | | available money collected before September 1, 2023, under Section |
|---|
| 24 | 24 | | 382.202(e) or 382.302 that was designated for the low-income |
|---|
| 25 | 25 | | vehicle repair assistance, retrofit, and accelerated vehicle |
|---|
| 26 | 26 | | retirement program and is appropriated by the legislature for the |
|---|
| 27 | 27 | | purposes described by this subsection. |
|---|
| 28 | 28 | | (c) The commission shall distribute the money in reasonable |
|---|
| 29 | 29 | | proportion to the amount of fees collected under Section 382.202(e) |
|---|
| 30 | 30 | | or 382.302 in those counties or in the regions in which those |
|---|
| 31 | 31 | | counties are located. |
|---|
| 32 | 32 | | (d) A county that receives money under this section may use |
|---|
| 33 | 33 | | the money only to fund a program authorized by Section 382.220(b). |
|---|
| 34 | 34 | | (e) This section expires September 1, 2027. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2023. |
