55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the provision of uninsured or underinsured motorist
88 coverage in automobile liability insurance policies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 912.002(b), Insurance Code, is amended
1111 to read as follows:
1212 (b) A county mutual insurance company is subject to:
1313 (1) Sections 38.001, 401.051, 401.052,
1414 401.054-401.062, 401.151, 401.152, 401.155, 401.156, 501.159,
1515 501.202, 501.203, 822.204, 1806.001, 1806.101, 1806.103(b),
1616 1806.104-1806.107, 1953.051(b), 2002.002, and 2002.005;
1717 (2) Subchapter A, Chapter 86;
1818 (3) Subchapter A, Chapter 401;
1919 (4) the provisions of Subchapter B, Chapter 424, other
2020 than Sections 424.052, 424.072, and 424.073;
2121 (5) Chapters 221, 251, 252, 254, 541, and 2210; [and]
2222 (6) Subchapter C, Chapter 1952; and
2323 (7) Articles 5.39 and 5.40.
2424 SECTION 2. Section 2301.053(b), Insurance Code, is amended
2525 to read as follows:
2626 (b) Each form for a personal automobile insurance policy
2727 must provide the coverages mandated under:
2828 (1) Subchapter [Subchapters] C, Chapter 1952; and
2929 (2) Subchapter D, Chapter 1952, unless the coverage is
3030 [coverages are] rejected by the named insured in the manner
3131 provided by that subchapter [those subchapters].
3232 SECTION 3. Section 1952.101(c), Insurance Code, is
3333 repealed.
3434 SECTION 4. The change in law made by this Act applies only
3535 to an insurance policy that is delivered, issued for delivery, or
3636 renewed on or after January 1, 2024. A policy delivered, issued for
3737 delivery, or renewed before January 1, 2024, is governed by the law
3838 as it existed immediately before the effective date of this Act, and
3939 that law is continued in effect for that purpose.
4040 SECTION 5. This Act takes effect September 1, 2023.
