55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the salaries of members of certain municipal police
88 departments and to state assistance payments to offset the cost of
99 those salaries.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 141, Local Government Code, is amended
1212 by adding Subchapter C to read as follows:
1313 SUBCHAPTER C. MINIMUM SALARY OF POLICE DEPARTMENT MEMBERS IN
1414 CERTAIN MUNICIPALITIES
1515 Sec. 141.051. DEFINITION. In this subchapter,
1616 "dishonorably discharged" has the meaning assigned by Section
1717 1701.452, Occupations Code.
1818 Sec. 141.052. APPLICABILITY. This subchapter applies only
1919 to a municipality with a population of 5,000 or less.
2020 Sec. 141.053. MINIMUM SALARY; ELIGIBILITY. (a)
2121 Notwithstanding any other law, the governing body of a municipality
2222 shall provide for each municipal fiscal year a salary of at least
2323 $55,000 to each eligible member of the police department.
2424 (b) To be eligible for the minimum salary under this
2525 section, a member of the police department must:
2626 (1) be a full-time employee; and
2727 (2) annually file with the municipality an affidavit
2828 in the form and manner prescribed by the municipality stating that
2929 the member:
3030 (A) has never been dishonorably discharged by any
3131 law enforcement agency; and
3232 (B) is not currently under investigation for
3333 alleged misconduct for which the member may be dishonorably
3434 discharged.
3535 Sec. 141.054. STATE FINANCIAL ASSISTANCE TO PAY MINIMUM
3636 SALARIES. (a) To serve the state purpose of ensuring professional
3737 law enforcement throughout the state, a municipality is entitled to
3838 an assistance payment from the state for each municipal fiscal year
3939 to assist the municipality in paying the minimum salary required by
4040 Section 141.053 for each eligible member of the police department
4141 in the municipality. A municipality is entitled to the assistance
4242 payment in an amount that equals the difference of $55,000 and the
4343 member's salary as paid by the municipality.
4444 (b) The governing body of the municipality may not reduce
4545 the portion of a salary paid to a member of the police department by
4646 the municipality as a result of receiving an assistance payment for
4747 that member.
4848 (c) Not later than the 30th day after the first day of a
4949 municipality's fiscal year, the municipality must submit an
5050 application to the comptroller in the form and manner prescribed by
5151 comptroller rule to receive the assistance payment. The
5252 application must include an affidavit described by Section
5353 141.053(b)(2) for each member of the police department in the
5454 municipality for whom the municipality is applying for an
5555 assistance payment.
5656 (d) The comptroller shall remit the applicable assistance
5757 payment to which a municipality is entitled from available state
5858 money not later than the 30th day after the date the comptroller
5959 receives the municipality's completed application for the
6060 assistance payment.
6161 (e) The comptroller shall adopt rules necessary to
6262 implement this section.
6363 SECTION 2. The changes in law made by this Act apply only to
6464 a municipal fiscal year that begins on or after January 1, 2024.
6565 SECTION 3. Not later than January 1, 2024, the comptroller
6666 of public accounts shall adopt rules as required by Section
6767 141.054(e), Local Government Code, as added by this Act.
6868 SECTION 4. This Act takes effect September 1, 2023.
