| 7 | 7 | | relating to a required online posting of certain environmental and |
|---|
| 8 | 8 | | water use permit applications. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter M, Chapter 5, Water Code, is amended |
|---|
| 11 | 11 | | by adding Section 5.559 to read as follows: |
|---|
| 12 | 12 | | Sec. 5.559. INTERNET WEBSITE POSTING OF APPLICATION. After |
|---|
| 13 | 13 | | an application is determined to be administratively complete, the |
|---|
| 14 | 14 | | applicant or the commission shall: |
|---|
| 15 | 15 | | (1) post on a publicly accessible Internet website: |
|---|
| 16 | 16 | | (A) the application; and |
|---|
| 17 | 17 | | (B) any subsequent revision or supplement to the |
|---|
| 18 | 18 | | application as the revision or supplement becomes available; and |
|---|
| 19 | 19 | | (2) until the commission takes final action on the |
|---|
| 20 | 20 | | application: |
|---|
| 21 | 21 | | (A) maintain the posting on the Internet website; |
|---|
| 22 | 22 | | and |
|---|
| 23 | 23 | | (B) include the address of the Internet website |
|---|
| 24 | 24 | | in any public notice the applicant or commission provides, as |
|---|
| 25 | 25 | | applicable, including under Section 5.552 or 5.553. |

| 26 | 26 | | SECTION 2. Subchapter D, Chapter 11, Water Code, is amended |
|---|
| 27 | 27 | | by adding Section 11.159 to read as follows: |
|---|
| 28 | 28 | | Sec. 11.159. INTERNET WEBSITE POSTING OF APPLICATION. |
|---|
| 29 | 29 | | After an application is determined to be administratively complete, |
|---|
| 30 | 30 | | the applicant or the commission shall: |
|---|
| 31 | 31 | | (1) post on a publicly accessible Internet website: |
|---|
| 32 | 32 | | (A) the application, the map, and any supporting |
|---|
| 33 | 33 | | materials required by this subchapter; and |
|---|
| 34 | 34 | | (B) any subsequent revision or supplement to the |
|---|
| 35 | 35 | | application as the revision or supplement becomes available; and |
|---|
| 36 | 36 | | (2) until the commission takes final action on the |
|---|
| 37 | 37 | | application: |
|---|
| 38 | 38 | | (A) maintain the posting; and |
|---|
| 39 | 39 | | (B) include the address of the Internet website |
|---|
| 40 | 40 | | in any public notice the applicant or commission provides, as |
|---|
| 41 | 41 | | applicable, including under Section 11.132. |
|---|
| 42 | 42 | | SECTION 3. The changes in law made by this Act apply only to |
|---|
| 43 | 43 | | an application received by the Texas Commission on Environmental |
|---|
| 44 | 44 | | Quality on or after the effective date of this Act. An application |
|---|
| 45 | 45 | | received before the effective date of this Act is governed by the |
|---|
| 46 | 46 | | law in effect on the date the application was received, and the |
|---|
| 47 | 47 | | former law is continued in effect for that purpose. |
|---|
| 48 | 48 | | SECTION 4. This Act takes effect September 1, 2023. |
