55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to criminal background check requirements for judges to
88 access vital records maintained by the Department of State Health
99 Services.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 191.071(b), Health and Safety Code, is
1212 amended to read as follows:
1313 (b) The department may adopt a policy waiving the
1414 requirement of a fingerprint-based background check for:
1515 (1) a person who previously submitted to a
1616 fingerprint-based background check as a condition of licensure by a
1717 state agency; or
1818 (2) a person serving as a judge or justice of the
1919 supreme court, the court of criminal appeals, a court of appeals, a
2020 district court, a criminal district court, a constitutional county
2121 court, a statutory county court, a justice court, or a municipal
2222 court.
2323 SECTION 2. This Act takes effect September 1, 2023.
