10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 191.071(b), Health and Safety Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (b) The department may adopt a policy waiving the |
---|
14 | 14 | | requirement of a fingerprint-based background check for: |
---|
15 | 15 | | (1) a person who previously submitted to a |
---|
16 | 16 | | fingerprint-based background check as a condition of licensure by a |
---|
17 | 17 | | state agency; or |
---|
18 | 18 | | (2) a person serving as a judge or justice of the |
---|
19 | 19 | | supreme court, the court of criminal appeals, a court of appeals, a |
---|
20 | 20 | | district court, a criminal district court, a constitutional county |
---|
21 | 21 | | court, a statutory county court, a justice court, or a municipal |
---|
22 | 22 | | court. |
---|
23 | 23 | | SECTION 2. This Act takes effect September 1, 2023. |
