66 AN ACT
77 relating to the development and operation by a regional mobility
88 authority of an urban green space or aesthetic enhancement located
99 above, adjacent to, or connected to an interstate highway.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 370.003(14), Transportation Code, is
1212 amended to read as follows:
1313 (14) "Transportation project" means:
1414 (A) a turnpike project;
1515 (B) a system;
1616 (C) a passenger or freight rail facility,
1717 including:
1818 (i) tracks;
1919 (ii) a rail line;
2020 (iii) switching, signaling, or other
2121 operating equipment;
2222 (iv) a depot;
2323 (v) a locomotive;
2424 (vi) rolling stock;
2525 (vii) a maintenance facility; and
2626 (viii) other real and personal property
2727 associated with a rail operation;
2828 (D) a roadway with a functional classification
2929 greater than a local road or rural minor collector;
3030 (D-1) a bridge;
3131 (E) a ferry;
3232 (F) an airport, other than an airport that on
3333 September 1, 2005, was served by one or more air carriers engaged in
3434 scheduled interstate transportation, as those terms were defined by
3535 14 C.F.R. Section 1.1 on that date;
3636 (G) a pedestrian or bicycle facility;
3737 (H) an intermodal hub;
3838 (I) an automated conveyor belt for the movement
3939 of freight;
4040 (J) a border crossing inspection station,
4141 including:
4242 (i) a border crossing inspection station
4343 located at or near an international border crossing; and
4444 (ii) a border crossing inspection station
4545 located at or near a border crossing from another state of the
4646 United States and not more than 50 miles from an international
4747 border;
4848 (K) an air quality improvement initiative;
4949 (L) a public utility facility;
5050 (M) a transit system;
5151 (M-1) a parking area, structure, or facility, or
5252 a collection device for parking fees;
5353 (N) if applicable, projects and programs listed
5454 in the most recently approved state implementation plan for the
5555 area covered by the authority, including an early action compact;
5656 (O) improvements in a transportation
5757 reinvestment zone designated under Subchapter E, Chapter 222;
5858 (P) port security, transportation, or facility
5959 projects eligible for funding under Section 55.002; [and]
6060 (Q) an aerial cable car or aerial tramway for the
6161 transportation of persons or property, or both, that is located in
6262 the jurisdiction of an authority created under Section 370.031(c);
6363 and
6464 (R) an urban green space or aesthetic enhancement
6565 located above, adjacent to, or connected to an interstate highway,
6666 which may include:
6767 (i) recreational, bicycle, and pedestrian
6868 facilities;
6969 (ii) an intermodal hub;
7070 (iii) parking areas; and
7171 (iv) components that will benefit users of
7272 transit, pedestrian, and other transportation modes, and promote
7373 economic development in areas on or adjacent to the urban green
7474 space or aesthetic enhancement.
7575 SECTION 2. This Act takes effect immediately if it receives
7676 a vote of two-thirds of all the members elected to each house, as
7777 provided by Section 39, Article III, Texas Constitution. If this
7878 Act does not receive the vote necessary for immediate effect, this
7979 Act takes effect September 1, 2023.
