10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 370.003(14), Transportation Code, is |
---|
12 | 12 | | amended to read as follows: |
---|
13 | 13 | | (14) "Transportation project" means: |
---|
14 | 14 | | (A) a turnpike project; |
---|
15 | 15 | | (B) a system; |
---|
16 | 16 | | (C) a passenger or freight rail facility, |
---|
17 | 17 | | including: |
---|
18 | 18 | | (i) tracks; |
---|
19 | 19 | | (ii) a rail line; |
---|
20 | 20 | | (iii) switching, signaling, or other |
---|
21 | 21 | | operating equipment; |
---|
22 | 22 | | (iv) a depot; |
---|
23 | 23 | | (v) a locomotive; |
---|
24 | 24 | | (vi) rolling stock; |
---|
25 | 25 | | (vii) a maintenance facility; and |
---|
26 | 26 | | (viii) other real and personal property |
---|
27 | 27 | | associated with a rail operation; |
---|
28 | 28 | | (D) a roadway with a functional classification |
---|
29 | 29 | | greater than a local road or rural minor collector; |
---|
30 | 30 | | (D-1) a bridge; |
---|
31 | 31 | | (E) a ferry; |
---|
32 | 32 | | (F) an airport, other than an airport that on |
---|
33 | 33 | | September 1, 2005, was served by one or more air carriers engaged in |
---|
34 | 34 | | scheduled interstate transportation, as those terms were defined by |
---|
35 | 35 | | 14 C.F.R. Section 1.1 on that date; |
---|
36 | 36 | | (G) a pedestrian or bicycle facility; |
---|
37 | 37 | | (H) an intermodal hub; |
---|
38 | 38 | | (I) an automated conveyor belt for the movement |
---|
39 | 39 | | of freight; |
---|
40 | 40 | | (J) a border crossing inspection station, |
---|
41 | 41 | | including: |
---|
42 | 42 | | (i) a border crossing inspection station |
---|
43 | 43 | | located at or near an international border crossing; and |
---|
44 | 44 | | (ii) a border crossing inspection station |
---|
45 | 45 | | located at or near a border crossing from another state of the |
---|
46 | 46 | | United States and not more than 50 miles from an international |
---|
47 | 47 | | border; |
---|
48 | 48 | | (K) an air quality improvement initiative; |
---|
49 | 49 | | (L) a public utility facility; |
---|
50 | 50 | | (M) a transit system; |
---|
51 | 51 | | (M-1) a parking area, structure, or facility, or |
---|
52 | 52 | | a collection device for parking fees; |
---|
53 | 53 | | (N) if applicable, projects and programs listed |
---|
54 | 54 | | in the most recently approved state implementation plan for the |
---|
55 | 55 | | area covered by the authority, including an early action compact; |
---|
56 | 56 | | (O) improvements in a transportation |
---|
57 | 57 | | reinvestment zone designated under Subchapter E, Chapter 222; |
---|
58 | 58 | | (P) port security, transportation, or facility |
---|
59 | 59 | | projects eligible for funding under Section 55.002; [and] |
---|
60 | 60 | | (Q) an aerial cable car or aerial tramway for the |
---|
61 | 61 | | transportation of persons or property, or both, that is located in |
---|
62 | 62 | | the jurisdiction of an authority created under Section 370.031(c); |
---|
63 | 63 | | and |
---|
64 | 64 | | (R) an urban green space or aesthetic enhancement |
---|
65 | 65 | | located above, adjacent to, or connected to an interstate highway, |
---|
66 | 66 | | which may include: |
---|
67 | 67 | | (i) recreational, bicycle, and pedestrian |
---|
68 | 68 | | facilities; |
---|
69 | 69 | | (ii) an intermodal hub; |
---|
70 | 70 | | (iii) parking areas; and |
---|
71 | 71 | | (iv) components that will benefit users of |
---|
72 | 72 | | transit, pedestrian, and other transportation modes, and promote |
---|
73 | 73 | | economic development in areas on or adjacent to the urban green |
---|
74 | 74 | | space or aesthetic enhancement. |
---|
75 | 75 | | SECTION 2. This Act takes effect immediately if it receives |
---|
76 | 76 | | a vote of two-thirds of all the members elected to each house, as |
---|
77 | 77 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
78 | 78 | | Act does not receive the vote necessary for immediate effect, this |
---|
79 | 79 | | Act takes effect September 1, 2023. |
