77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 1305.157, Occupations Code, is amended
99 to read as follows:
1010 Sec. 1305.157. RESIDENTIAL WIREMAN. An applicant for a
1111 license as a residential wireman must:
1212 (1) either:
1313 (A) have at least 4,000 hours of on-the-job
1414 training under the supervision of a master electrician or
1515 residential wireman; or
1616 (B) successfully complete a career and
1717 technology education program described by Section 1305.1575; and
1818 (2) pass a residential wireman examination
1919 administered under this chapter.
2020 SECTION 2. Subchapter D, Chapter 1305, Occupations Code, is
2121 amended by adding Section 1305.1575 to read as follows:
2222 Sec. 1305.1575. CAREER AND TECHNOLOGY EDUCATION PROGRAM FOR
2323 RESIDENTIAL WIREMAN LICENSE; INSTRUCTORS. (a) In this section:
2424 (1) "Career and technology education program" means:
2525 (A) a career and technology education program
2626 under Subchapter F, Chapter 29, Education Code; or
2727 (B) a program determined by the department to be
2828 similar to that described by Paragraph (A) and offered by:
2929 (i) an institution of higher education; or
3030 (ii) a private school, as defined by
3131 Section 5.001, Education Code.
3232 (2) "Institution of higher education" means an
3333 institution of higher education or a private or independent
3434 institution of higher education, as those terms are defined by
3535 Section 61.003, Education Code.
3636 (b) A person who successfully completes a sequence of
3737 courses in the electrical trade that are offered through a career
3838 and technology education program may apply for and take an
3939 examination for a license as a residential wireman, regardless of
4040 whether the person has completed the number of hours of on-the-job
4141 training required by Section 1305.157(1).
4242 (c) The commission by rule shall establish standards for the
4343 essential knowledge and skills of a career and technology education
4444 program described by Subsection (b), subject to the approval of the
4545 State Board of Education if the courses are to be offered in a high
4646 school. The rules must:
4747 (1) require the program to consist of an appropriate
4848 number of hours of classroom instruction and a practical component;
4949 and
5050 (2) provide for crediting appropriate on-the-job
5151 training toward meeting the requirements of the practical
5252 component.
5353 (d) A student of any age enrolled in a career and technology
5454 education program is eligible to take the sequence of courses
5555 described by Subsection (b) without being licensed under this
5656 chapter. This subsection does not authorize a person to perform
5757 electrical work without the appropriate license outside of a
5858 program described by this section.
5959 (e) A person may not provide instruction in a program
6060 described by this section unless the person is licensed as a master
6161 electrician, journeyman electrician, or residential wireman.
6262 (f) A career and technology education program offered under
6363 this section by an institution of higher education may not be more
6464 stringent than a program offered by a public high school.
6565 (g) Hours spent completing a program described by this
6666 section may not be credited toward any on-the-job training required
6767 to apply for a license under this chapter.
6868 SECTION 3. The heading to Section 1305.167, Occupations
6969 Code, is amended to read as follows:
7070 Sec. 1305.167. LICENSE RENEWAL; FEE EXEMPTION.
7171 SECTION 4. Section 1305.167, Occupations Code, is amended
7272 by adding Subsection (d) to read as follows:
7373 (d) A license holder who provides instruction in a career
7474 and technology education program described by Section 1305.1575 is
7575 not required to pay a fee to renew the license.
7676 SECTION 5. As soon as practicable after the effective date
7777 of this Act, the Texas Commission of Licensing and Regulation shall
7878 adopt rules necessary to implement the changes in law made by this
7979 Act to Chapter 1305, Occupations Code.
8080 SECTION 6. In developing the initial standards for the
8181 career and technology education program under Section
8282 1305.1575(c), Occupations Code, as added by this Act, the Texas
8383 Commission of Licensing and Regulation shall consult with the Texas
8484 State Technical College and relevant interest groups in the
8585 electrical industry.
8686 SECTION 7. This Act takes effect immediately if it receives
8787 a vote of two-thirds of all the members elected to each house, as
8888 provided by Section 39, Article III, Texas Constitution. If this
8989 Act does not receive the vote necessary for immediate effect, this
9090 Act takes effect September 1, 2023.
