66 AN ACT
77 relating to the provision of community recovery organization
88 peer-to-peer services under Medicaid.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.09991 to read as follows:
1212 Sec. 531.09991. COMMUNITY RECOVERY ORGANIZATIONS. (a) In
1313 this section, "community recovery organization" means a nonprofit
1414 organization that:
1515 (1) mobilizes resources inside and outside of a local
1616 community to increase the prevalence and quality of long-term
1717 recovery for individuals with a substance use or mental health
1818 condition and their affected family members;
1919 (2) is governed by members of the local community:
2020 (A) at least 51 percent of whom identify as an
2121 individual recovering from a substance use or mental health
2222 condition; and
2323 (B) the remainder of whom identify as an affected
2424 family member of an individual recovering from a substance use or
2525 mental health condition; and
2626 (3) aligns with applicable national best practices
2727 recognized by the commission.
2828 (b) The executive commissioner shall adopt rules to provide
2929 Medicaid reimbursement for peer-to-peer services provided by
3030 community recovery organizations, which must include:
3131 (1) rules that establish training requirements for
3232 community recovery organization peer-to-peer service providers;
3333 (2) rules that establish certification and
3434 supervision requirements for community recovery organizations;
3535 (3) rules that define the scope of peer-to-peer
3636 services that community recovery organizations may provide;
3737 (4) rules that distinguish peer-to-peer services
3838 provided by community recovery organizations from other services
3939 that a person must hold a license to provide; and
4040 (5) any other rules necessary to protect the health
4141 and safety of individuals receiving services provided by community
4242 recovery organizations.
4343 (c) The executive commissioner shall establish a work group
4444 to provide input for the adoption of rules under Subsection (b) and
4545 shall consider that input in adopting rules under that subsection.
4646 The work group is composed of at least nine but not more than 13
4747 members with expertise in substance use disorder recovery or
4848 community recovery organizations. The executive commissioner
4949 shall ensure that at least half of the work group members are from
5050 rural communities in this state.
5151 (d) The executive commissioner shall appoint one work group
5252 member to serve as presiding officer.
5353 (e) The work group is automatically abolished on the
5454 adoption of rules under Subsection (b).
5555 (f) Subsections (c), (d), and (e) and this subsection expire
5656 September 1, 2025.
5757 SECTION 2. Effective January 1, 2025, Section 32.024, Human
5858 Resources Code, is amended by adding Subsection (pp) to read as
5959 follows:
6060 (pp) The commission in the commission's rules and standards
6161 governing the scope of services provided under the medical
6262 assistance program shall include peer-to-peer services provided by
6363 community recovery organizations as defined by Section 531.09991,
6464 Government Code, to the extent permitted by federal law.
6565 SECTION 3. Not later than December 31, 2023, the executive
6666 commissioner of the Health and Human Services Commission shall
6767 establish the work group required by Section 531.09991, Government
6868 Code, as added by this Act.
6969 SECTION 4. Not later than December 31, 2024, the executive
7070 commissioner of the Health and Human Services Commission shall
7171 adopt the rules required by Section 531.09991, Government Code, as
7272 added by this Act.
7373 SECTION 5. If before implementing any provision of this Act
7474 a state agency determines that a waiver or authorization from a
7575 federal agency is necessary for implementation of that provision,
7676 the agency affected by the provision shall request the waiver or
7777 authorization and may delay implementing that provision until the
7878 waiver or authorization is granted.
7979 SECTION 6. Except as otherwise provided by this Act, this
8080 Act takes effect September 1, 2023.
