| 5 | 5 | | relating to the expiration of a protective order when the subject of |

| 6 | 6 | | the protective order is confined or imprisoned. |

| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 85.025, Family Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (d) to read as follows: |
|---|
| 10 | 10 | | (d) As soon as practicable after the release of a person who |
|---|
| 11 | 11 | | is the subject of a protective order from confinement or |
|---|
| 12 | 12 | | imprisonment, the Department of Public Safety shall update the |
|---|
| 13 | 13 | | statewide law enforcement information system maintained by the |
|---|
| 14 | 14 | | department to reflect the date that the order will expire following |
|---|
| 15 | 15 | | the person's release. |
|---|
| 16 | 16 | | SECTION 2. Section 85.026, Family Code, is amended by |
|---|
| 17 | 17 | | adding Subsection (d) to read as follows: |
|---|
| 18 | 18 | | (d) Each protective order issued under this subtitle must |
|---|
| 19 | 19 | | specify when the order expires and must provide notice of any |
|---|
| 20 | 20 | | extensions that may apply to a person who is the subject of the |
|---|
| 21 | 21 | | order, as a result of any confinement or imprisonment of that |
|---|
| 22 | 22 | | person. |
|---|
| 23 | 23 | | SECTION 3. Section 85.025(d), Family Code, as added by this |
|---|
| 24 | 24 | | Act, applies only to a protective order with respect to a person who |
|---|
| 25 | 25 | | is the subject of the order and who is released from confinement or |
|---|
| 26 | 26 | | imprisonment on or after the effective date of this Act. |
|---|
| 27 | 27 | | SECTION 4. Section 85.026(d), Family Code, as added by this |
|---|
| 28 | 28 | | Act, applies only to a protective order issued on or after the |
|---|
| 29 | 29 | | effective date of this Act. |
|---|
| 30 | 30 | | SECTION 5. This Act takes effect September 1, 2023. |
