55 relating to the expiration of a protective order when the subject of
66 the protective order is confined or imprisoned.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 85.025, Family Code, is amended by
99 adding Subsection (d) to read as follows:
1010 (d) As soon as practicable after the release of a person who
1111 is the subject of a protective order from confinement or
1212 imprisonment, the Department of Public Safety shall update the
1313 statewide law enforcement information system maintained by the
1414 department to reflect the date that the order will expire following
1515 the person's release.
1616 SECTION 2. Section 85.026, Family Code, is amended by
1717 adding Subsection (d) to read as follows:
1818 (d) Each protective order issued under this subtitle must
1919 specify when the order expires and must provide notice of any
2020 extensions that may apply to a person who is the subject of the
2121 order, as a result of any confinement or imprisonment of that
2222 person.
2323 SECTION 3. Section 85.025(d), Family Code, as added by this
2424 Act, applies only to a protective order with respect to a person who
2525 is the subject of the order and who is released from confinement or
2626 imprisonment on or after the effective date of this Act.
2727 SECTION 4. Section 85.026(d), Family Code, as added by this
2828 Act, applies only to a protective order issued on or after the
2929 effective date of this Act.
3030 SECTION 5. This Act takes effect September 1, 2023.
