77 relating to restrictions on rent increases for self-service storage
88 facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 93, Property Code, is amended by adding
1111 Section 93.014 to read as follows:
1212 Sec. 93.014. RENT INCREASE FOR SELF-SERVICE STORAGE
1313 FACILITY. (a) In this section:
1414 (1) "Lease" means a written rental agreement.
1515 (2) "Lessor," "rental agreement," "self-service
1616 storage facility," and "tenant" have the meanings assigned by
1717 Section 59.001.
1818 (b) This section applies to a lease regardless of:
1919 (1) the length of the lease term; or
2020 (2) whether the lease includes a fixed term.
2121 (c) The lessor of a self-service storage facility may not
2222 increase a tenant's rent:
2323 (1) before the first anniversary of the date the
2424 tenant's initial lease is signed by the tenant; or
2525 (2) unless the lessor provides written notice of the
2626 increased rent amount at least 30 days before the date of the
2727 proposed rent increase.
2828 SECTION 2. This Act applies to a self-service storage
2929 facility lease entered into, extended, or renewed on or after the
3030 effective date of this Act.
3131 SECTION 3. This Act takes effect September 1, 2023.
