| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 93, Property Code, is amended by adding |
|---|
| 11 | 11 | | Section 93.014 to read as follows: |
|---|
| 12 | 12 | | Sec. 93.014. RENT INCREASE FOR SELF-SERVICE STORAGE |
|---|
| 13 | 13 | | FACILITY. (a) In this section: |
|---|
| 14 | 14 | | (1) "Lease" means a written rental agreement. |
|---|
| 15 | 15 | | (2) "Lessor," "rental agreement," "self-service |
|---|
| 16 | 16 | | storage facility," and "tenant" have the meanings assigned by |
|---|
| 17 | 17 | | Section 59.001. |
|---|
| 18 | 18 | | (b) This section applies to a lease regardless of: |
|---|
| 19 | 19 | | (1) the length of the lease term; or |
|---|
| 20 | 20 | | (2) whether the lease includes a fixed term. |
|---|
| 21 | 21 | | (c) The lessor of a self-service storage facility may not |
|---|
| 22 | 22 | | increase a tenant's rent: |
|---|
| 23 | 23 | | (1) before the first anniversary of the date the |
|---|
| 24 | 24 | | tenant's initial lease is signed by the tenant; or |
|---|
| 25 | 25 | | (2) unless the lessor provides written notice of the |
|---|
| 26 | 26 | | increased rent amount at least 30 days before the date of the |
|---|
| 27 | 27 | | proposed rent increase. |
|---|
| 28 | 28 | | SECTION 2. This Act applies to a self-service storage |
|---|
| 29 | 29 | | facility lease entered into, extended, or renewed on or after the |
|---|
| 30 | 30 | | effective date of this Act. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2023. |
