66 AN ACT
77 relating to establishing a minimum wage for certain personal
88 attendants under Medicaid and other programs administered by the
99 Health and Human Services Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 533, Government Code, is
1212 amended by adding Section 533.00523 to read as follows:
1313 Sec. 533.00523. COMPLIANCE WITH MINIMUM WAGE FOR CERTAIN
1414 PERSONAL ATTENDANTS. A contract between a managed care
1515 organization and the commission to provide health care services to
1616 recipients must require that the organization ensure provider
1717 compliance with the minimum wage requirement for personal
1818 attendants under Section 531.603.
1919 SECTION 2. Chapter 531, Government Code, is amended by
2020 adding Subchapter P to read as follows:
2121 SUBCHAPTER P. PERSONAL ATTENDANT SERVICES
2222 Sec. 531.601. DEFINITIONS. In this subchapter:
2323 (1) "Continuing care facility" means a facility
2424 regulated under Chapter 246, Health and Safety Code.
2525 (2) "Family care program" means the program authorized
2626 under Subtitle A, Title XX of the Social Security Act (42 U.S.C.
2727 Section 1397 et seq.) to provide personal attendant services to
2828 eligible individuals.
2929 (3) "Home and community support services agency" means
3030 a person licensed under Chapter 142, Health and Safety Code.
3131 (4) "Personal attendant" means an individual employed
3232 or contracted by a provider agency or by an employer or designated
3333 representative under a consumer direction model implemented under
3434 Section 531.051 to provide personal attendant services. The term
3535 does not include an individual described by Section 142.003(a)(1)
3636 or (2), Health and Safety Code.
3737 (5) "Personal attendant services" means nonmedical
3838 services that enable an individual to engage in the activities of
3939 daily living or to perform the physical functions required for
4040 independent living, including:
4141 (A) bathing, dressing, grooming, feeding,
4242 exercising, toileting, positioning, assisting with
4343 self-administered medications, routine hair and skin care, and
4444 transfer or ambulation; and
4545 (B) light housekeeping, grocery shopping, meal
4646 preparation, and laundry.
4747 (6) "Provider agency" means an agency that contracts
4848 with the commission or with a Medicaid managed care organization to
4949 provide personal attendant services to individuals receiving
5050 services under Medicaid or the family care program. The term
5151 includes a home and community support services agency and a
5252 continuing care facility.
5353 Sec. 531.602. APPLICABILITY. This subchapter applies only to
5454 a personal attendant who provides personal attendant services to:
5555 (1) a Medicaid recipient, including a recipient under:
5656 (A) the Medicaid managed care program under
5757 Chapter 533;
5858 (B) the community attendant services program
5959 described by Section 32.061, Human Resources Code;
6060 (C) the primary home care program; and
6161 (D) a Section 1915(c) waiver program; or
6262 (2) an individual who receives services under the
6363 family care program.
6464 Sec. 531.603. MINIMUM WAGE FOR PERSONAL ATTENDANTS. (a)
6565 Notwithstanding Section 62.051 or 62.151, Labor Code, or any other
6666 law, a provider agency or employer or designated representative
6767 under a consumer direction model implemented under Section 531.051
6868 must pay a personal attendant to whom this subchapter applies a base
6969 wage that is not less than the greater of:
7070 (1) $17 an hour; or
7171 (2) the federal minimum wage under Section 6, Fair
7272 Labor Standards Act of 1938 (29 U.S.C. Section 206).
7373 (b) This subsection applies to only the 2024 calendar year.
7474 Subsection (a) does not apply in the year to which this subsection
7575 applies. Notwithstanding Section 62.051 or 62.151, Labor Code, or
7676 any other law, a provider agency or employer or designated
7777 representative under a consumer direction model implemented under
7878 Section 531.051 must pay a personal attendant to whom this
7979 subchapter applies a base wage that is not less than the greater of:
8080 (1) $15 an hour; or
8181 (2) the federal minimum wage under Section 6, Fair
8282 Labor Standards Act of 1938 (29 U.S.C. Section 206).
8383 (c) Subsection (b) and this subsection expire January 1,
8484 2025.
8585 SECTION 3. Section 531.603, Government Code, as added by
8686 this Act, applies beginning with the 2024 calendar year.
8787 SECTION 4. If before implementing any provision of this Act
8888 a state agency determines that a waiver or authorization from a
8989 federal agency is necessary for implementation of that provision,
9090 the agency affected by the provision shall request the waiver or
9191 authorization and may delay implementing that provision until the
9292 waiver or authorization is granted.
9393 SECTION 5. This Act takes effect September 1, 2023.
