| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 22.034, Local Government Code, is |
|---|
| 9 | 9 | | amended by adding Subsection (d) to read as follows: |
|---|
| 10 | 10 | | (d) If the aldermen of the governing body of a municipality |
|---|
| 11 | 11 | | are not serving staggered terms of office as provided by Subsection |
|---|
| 12 | 12 | | (c), the governing body by majority vote may establish staggered |
|---|
| 13 | 13 | | terms by requiring the aldermen to draw lots. |
|---|
| 14 | 14 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 15 | 15 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 16 | 16 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 17 | 17 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 18 | 18 | | Act takes effect September 1, 2023. |
