| 7 | 7 | | relating to the authority of a county or municipality to require |

| 8 | 8 | | removal of graffiti from private property. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 250.006(c), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (c) The order or ordinance must require a property owner to |
|---|
| 13 | 13 | | remove the graffiti on or before the 10th [15th] day after the date |
|---|
| 14 | 14 | | the property owner receives notice under Subsection (a). If the |
|---|
| 15 | 15 | | property owner fails to remove the graffiti on or before the 10th |
|---|
| 16 | 16 | | [15th] day after the date of receipt of the notice, the county or |
|---|
| 17 | 17 | | municipality may remove the graffiti and charge the expenses of |
|---|
| 18 | 18 | | removal to the property owner in accordance with a fee schedule |
|---|
| 19 | 19 | | adopted by the county or municipality. |
|---|
| 20 | 20 | | SECTION 2. Section 250.006(b), Local Government Code, is |
|---|
| 21 | 21 | | repealed. |
|---|
| 22 | 22 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 23 | 23 | | to an order or ordinance adopted on or after the effective date of |
|---|
| 24 | 24 | | this Act. An order or ordinance adopted before the effective date |
|---|
| 25 | 25 | | of this Act is governed by the law in effect on the date the order or |
|---|
| 26 | 26 | | ordinance was adopted, and that law is continued in effect for that |
|---|
| 27 | 27 | | purpose. |
|---|
| 28 | 28 | | SECTION 4. This Act takes effect September 1, 2023. |
