| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 252.048, Local Government Code, is |
|---|
| 9 | 9 | | amended by amending Subsection (c-1) and adding Subsection (e) to |
|---|
| 10 | 10 | | read as follows: |
|---|
| 11 | 11 | | (c-1) If a change order for a public works contract in a |
|---|
| 12 | 12 | | municipality with a population of 240,000 [300,000] or more |
|---|
| 13 | 13 | | involves a decrease or an increase of $100,000 or less, or a lesser |
|---|
| 14 | 14 | | amount as provided by ordinance, the governing body of the |
|---|
| 15 | 15 | | municipality may grant general authority to an administrative |
|---|
| 16 | 16 | | official of the municipality to approve the change order. |
|---|
| 17 | 17 | | (e) This section applies only to a contract awarded through |
|---|
| 18 | 18 | | a competitive procedure as required by Section 252.021. |
|---|
| 19 | 19 | | SECTION 2. The changes in law made by this Act apply only to |
|---|
| 20 | 20 | | a change order approved on or after the effective date of this Act. |
|---|
| 21 | 21 | | A change order approved before the effective date of this Act is |
|---|
| 22 | 22 | | governed by the law in effect on the date the change order was |
|---|
| 23 | 23 | | approved, and the former law is continued in effect for that |
|---|
| 24 | 24 | | purpose. |
|---|
| 25 | 25 | | SECTION 3. This Act takes effect September 1, 2023. |
