55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the inclusion of the mailing address of certain
88 campaign treasurers in appointments and reports filed with the
99 Texas Ethics Commission.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 252.002(a), Election Code, is amended to
1212 read as follows:
1313 (a) A campaign treasurer appointment must be in writing and
1414 include:
1515 (1) the campaign treasurer's name;
1616 (2) the campaign treasurer's residence, mailing, or
1717 business street address;
1818 (3) the campaign treasurer's telephone number; and
1919 (4) the name of the person making the appointment.
2020 SECTION 2. Section 254.061, Election Code, is amended to
2121 read as follows:
2222 Sec. 254.061. ADDITIONAL CONTENTS OF REPORTS. In addition
2323 to the contents required by Section 254.031, each report by a
2424 candidate must include:
2525 (1) the candidate's full name and address, the office
2626 sought, and the identity and date of the election for which the
2727 report is filed;
2828 (2) the campaign treasurer's name, residence, mailing,
2929 or business street address, and telephone number;
3030 (3) for each political committee from which the
3131 candidate received notice under Section 254.128 or 254.161:
3232 (A) the committee's full name and address;
3333 (B) an indication of whether the committee is a
3434 general-purpose committee or a specific-purpose committee; and
3535 (C) the full name and address of the committee's
3636 campaign treasurer; and
3737 (4) on a separate page or pages of the report, the
3838 identification of any payment from political contributions made to
3939 a business in which the candidate has a participating interest of
4040 more than 10 percent, holds a position on the governing body of the
4141 business, or serves as an officer of the business.
4242 SECTION 3. Section 254.121, Election Code, is amended to
4343 read as follows:
4444 Sec. 254.121. ADDITIONAL CONTENTS OF REPORTS. In addition
4545 to the contents required by Section 254.031, each report by a
4646 campaign treasurer of a specific-purpose committee must include:
4747 (1) the committee's full name and address;
4848 (2) the full name, residence, mailing, or business
4949 street address, and telephone number of the committee's campaign
5050 treasurer;
5151 (3) the identity and date of the election for which the
5252 report is filed, if applicable;
5353 (4) the name of each candidate and each measure
5454 supported or opposed by the committee, indicating for each whether
5555 the committee supports or opposes;
5656 (5) the name of each officeholder assisted by the
5757 committee;
5858 (6) the amount of each political expenditure in the
5959 form of a political contribution that is made to a candidate,
6060 officeholder, or another political committee and that is returned
6161 to the committee during the reporting period, the name of the person
6262 to whom the expenditure was originally made, and the date it is
6363 returned;
6464 (7) on a separate page or pages of the report, the
6565 identification of any payment from political contributions made to
6666 a business in which the candidate or officeholder has a
6767 participating interest of more than 10 percent, holds a position on
6868 the governing body of the business, or serves as an officer of the
6969 business; and
7070 (8) on a separate page or pages of the report, the
7171 identification of any contribution from a corporation or labor
7272 organization made and accepted under Subchapter D, Chapter 253.
7373 SECTION 4. Section 254.151, Election Code, is amended to
7474 read as follows:
7575 Sec. 254.151. ADDITIONAL CONTENTS OF REPORTS. In addition
7676 to the contents required by Section 254.031, each report by a
7777 campaign treasurer of a general-purpose committee must include:
7878 (1) the committee's full name and address;
7979 (2) the full name, residence, mailing, or business
8080 street address, and telephone number of the committee's campaign
8181 treasurer;
8282 (3) the identity and date of the election for which the
8383 report is filed, if applicable;
8484 (4) the name of each identified candidate or measure
8585 or classification by party of candidates supported or opposed by
8686 the committee, indicating whether the committee supports or opposes
8787 each listed candidate, measure, or classification by party of
8888 candidates;
8989 (5) the name of each identified officeholder or
9090 classification by party of officeholders assisted by the committee;
9191 (6) the principal occupation of each person from whom
9292 political contributions that in the aggregate exceed $50 are
9393 accepted during the reporting period;
9494 (7) the amount of each political expenditure in the
9595 form of a political contribution made to a candidate, officeholder,
9696 or another political committee that is returned to the committee
9797 during the reporting period, the name of the person to whom the
9898 expenditure was originally made, and the date it is returned;
9999 (8) on a separate page or pages of the report, the
100100 identification of any contribution from a corporation or labor
101101 organization made and accepted under Subchapter D, Chapter 253; and
102102 (9) on a separate page or pages of the report, the
103103 identification of the name of the donor, the amount, and the date of
104104 any expenditure made by a corporation or labor organization to:
105105 (A) establish or administer the political
106106 committee; or
107107 (B) finance the solicitation of political
108108 contributions to the committee under Section 253.100.
109109 SECTION 5. The changes in law made by this Act apply only to
110110 a campaign treasurer appointment required to be filed under Chapter
111111 252, Election Code, or a report required to be filed under Chapter
112112 254, Election Code, on or after the effective date of this Act. A
113113 campaign treasurer appointment or report required to be filed
114114 before the effective date of this Act is subject to the law in
115115 effect at the time the appointment or report was filed, and the
116116 former law is continued in effect for that purpose.
117117 SECTION 6. This Act takes effect immediately if it receives
118118 a vote of two-thirds of all the members elected to each house, as
119119 provided by Section 39, Article III, Texas Constitution. If this
120120 Act does not receive the vote necessary for immediate effect, this
121121 Act takes effect September 1, 2023.
