7 | 7 | | relating to the inclusion of the mailing address of certain |
---|
8 | 8 | | campaign treasurers in appointments and reports filed with the |
---|
9 | 9 | | Texas Ethics Commission. |
---|
10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Section 252.002(a), Election Code, is amended to |
---|
12 | 12 | | read as follows: |
---|
13 | 13 | | (a) A campaign treasurer appointment must be in writing and |
---|
14 | 14 | | include: |
---|
15 | 15 | | (1) the campaign treasurer's name; |
---|
16 | 16 | | (2) the campaign treasurer's residence, mailing, or |
---|
17 | 17 | | business street address; |
---|
18 | 18 | | (3) the campaign treasurer's telephone number; and |
---|
19 | 19 | | (4) the name of the person making the appointment. |
---|
20 | 20 | | SECTION 2. Section 254.061, Election Code, is amended to |
---|
21 | 21 | | read as follows: |
---|
22 | 22 | | Sec. 254.061. ADDITIONAL CONTENTS OF REPORTS. In addition |
---|
23 | 23 | | to the contents required by Section 254.031, each report by a |
---|
24 | 24 | | candidate must include: |
---|
25 | 25 | | (1) the candidate's full name and address, the office |
---|
26 | 26 | | sought, and the identity and date of the election for which the |
---|
27 | 27 | | report is filed; |
---|
28 | 28 | | (2) the campaign treasurer's name, residence, mailing, |
---|
29 | 29 | | or business street address, and telephone number; |
---|
30 | 30 | | (3) for each political committee from which the |
---|
31 | 31 | | candidate received notice under Section 254.128 or 254.161: |
---|
32 | 32 | | (A) the committee's full name and address; |
---|
33 | 33 | | (B) an indication of whether the committee is a |
---|
34 | 34 | | general-purpose committee or a specific-purpose committee; and |
---|
35 | 35 | | (C) the full name and address of the committee's |
---|
36 | 36 | | campaign treasurer; and |
---|
37 | 37 | | (4) on a separate page or pages of the report, the |
---|
38 | 38 | | identification of any payment from political contributions made to |
---|
39 | 39 | | a business in which the candidate has a participating interest of |
---|
40 | 40 | | more than 10 percent, holds a position on the governing body of the |
---|
41 | 41 | | business, or serves as an officer of the business. |
---|
42 | 42 | | SECTION 3. Section 254.121, Election Code, is amended to |
---|
43 | 43 | | read as follows: |
---|
44 | 44 | | Sec. 254.121. ADDITIONAL CONTENTS OF REPORTS. In addition |
---|
45 | 45 | | to the contents required by Section 254.031, each report by a |
---|
46 | 46 | | campaign treasurer of a specific-purpose committee must include: |
---|
47 | 47 | | (1) the committee's full name and address; |
---|
48 | 48 | | (2) the full name, residence, mailing, or business |
---|
49 | 49 | | street address, and telephone number of the committee's campaign |
---|
50 | 50 | | treasurer; |
---|
51 | 51 | | (3) the identity and date of the election for which the |
---|
52 | 52 | | report is filed, if applicable; |
---|
53 | 53 | | (4) the name of each candidate and each measure |
---|
54 | 54 | | supported or opposed by the committee, indicating for each whether |
---|
55 | 55 | | the committee supports or opposes; |
---|
56 | 56 | | (5) the name of each officeholder assisted by the |
---|
57 | 57 | | committee; |
---|
58 | 58 | | (6) the amount of each political expenditure in the |
---|
59 | 59 | | form of a political contribution that is made to a candidate, |
---|
60 | 60 | | officeholder, or another political committee and that is returned |
---|
61 | 61 | | to the committee during the reporting period, the name of the person |
---|
62 | 62 | | to whom the expenditure was originally made, and the date it is |
---|
63 | 63 | | returned; |
---|
64 | 64 | | (7) on a separate page or pages of the report, the |
---|
65 | 65 | | identification of any payment from political contributions made to |
---|
66 | 66 | | a business in which the candidate or officeholder has a |
---|
67 | 67 | | participating interest of more than 10 percent, holds a position on |
---|
68 | 68 | | the governing body of the business, or serves as an officer of the |
---|
69 | 69 | | business; and |
---|
70 | 70 | | (8) on a separate page or pages of the report, the |
---|
71 | 71 | | identification of any contribution from a corporation or labor |
---|
72 | 72 | | organization made and accepted under Subchapter D, Chapter 253. |
---|
73 | 73 | | SECTION 4. Section 254.151, Election Code, is amended to |
---|
74 | 74 | | read as follows: |

---|

---|

80 | 80 | | street address, and telephone number of the committee's campaign |
---|
81 | 81 | | treasurer; |
---|
82 | 82 | | (3) the identity and date of the election for which the |
---|
83 | 83 | | report is filed, if applicable; |
---|
84 | 84 | | (4) the name of each identified candidate or measure |
---|
85 | 85 | | or classification by party of candidates supported or opposed by |
---|
86 | 86 | | the committee, indicating whether the committee supports or opposes |
---|
87 | 87 | | each listed candidate, measure, or classification by party of |
---|
88 | 88 | | candidates; |
---|
89 | 89 | | (5) the name of each identified officeholder or |
---|
90 | 90 | | classification by party of officeholders assisted by the committee; |
---|
91 | 91 | | (6) the principal occupation of each person from whom |
---|
92 | 92 | | political contributions that in the aggregate exceed $50 are |
---|
93 | 93 | | accepted during the reporting period; |
---|
94 | 94 | | (7) the amount of each political expenditure in the |
---|
95 | 95 | | form of a political contribution made to a candidate, officeholder, |
---|
96 | 96 | | or another political committee that is returned to the committee |
---|
97 | 97 | | during the reporting period, the name of the person to whom the |
---|
98 | 98 | | expenditure was originally made, and the date it is returned; |
---|
99 | 99 | | (8) on a separate page or pages of the report, the |
---|
100 | 100 | | identification of any contribution from a corporation or labor |
---|
101 | 101 | | organization made and accepted under Subchapter D, Chapter 253; and |
---|
102 | 102 | | (9) on a separate page or pages of the report, the |
---|
103 | 103 | | identification of the name of the donor, the amount, and the date of |
---|
104 | 104 | | any expenditure made by a corporation or labor organization to: |
---|
105 | 105 | | (A) establish or administer the political |
---|
106 | 106 | | committee; or |
---|
107 | 107 | | (B) finance the solicitation of political |
---|
108 | 108 | | contributions to the committee under Section 253.100. |
---|
109 | 109 | | SECTION 5. The changes in law made by this Act apply only to |
---|
110 | 110 | | a campaign treasurer appointment required to be filed under Chapter |
---|
111 | 111 | | 252, Election Code, or a report required to be filed under Chapter |
---|
112 | 112 | | 254, Election Code, on or after the effective date of this Act. A |
---|
113 | 113 | | campaign treasurer appointment or report required to be filed |
---|
114 | 114 | | before the effective date of this Act is subject to the law in |
---|
115 | 115 | | effect at the time the appointment or report was filed, and the |
---|
116 | 116 | | former law is continued in effect for that purpose. |
---|
117 | 117 | | SECTION 6. This Act takes effect immediately if it receives |
---|
118 | 118 | | a vote of two-thirds of all the members elected to each house, as |
---|
119 | 119 | | provided by Section 39, Article III, Texas Constitution. If this |
---|
120 | 120 | | Act does not receive the vote necessary for immediate effect, this |
---|
121 | 121 | | Act takes effect September 1, 2023. |
