55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to food allergen awareness in food service establishments,
88 food manager certifications, and food service programs.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. This Act may be cited as the Sergio Lopez Food
1111 Allergy Awareness Act.
1212 SECTION 2. Chapter 437, Health and Safety Code, is amended
1313 by adding Section 437.027 to read as follows:
1414 Sec. 437.027. FOOD ALLERGEN AWARENESS POSTER. (a) A food
1515 service establishment shall display a poster relating to food
1616 allergen awareness in an area of the establishment regularly
1717 accessible to the establishment's food service employees. The
1818 department shall:
1919 (1) collaborate with individuals with expertise and
2020 knowledge regarding food allergies to determine the form and
2121 content of the poster;
2222 (2) post a sample poster on the department's Internet
2323 website; and
2424 (3) update the poster as necessary to ensure the
2525 poster contains current information about food allergens and
2626 remains consistent with standards promulgated by the United States
2727 Food and Drug Administration.
2828 (b) The poster must include information regarding:
2929 (1) the risk of an allergic reaction to a food
3030 allergen;
3131 (2) symptoms of an allergic reaction;
3232 (3) the major food allergens, as determined by federal
3333 law and regulations of the United States Food and Drug
3434 Administration;
3535 (4) the procedures for preventing an allergic
3636 reaction; and
3737 (5) appropriate responses for assisting an individual
3838 who is having an allergic reaction.
3939 (c) The executive commissioner shall adopt rules necessary
4040 to implement this section.
4141 (d) This section does not create a private cause of action
4242 or change any common law or statutory duty.
4343 (e) Notwithstanding any other law, a county, municipality,
4444 or public health district may not adopt or enforce an order,
4545 ordinance, rule, or other measure that is inconsistent with or
4646 exceeds the requirements of this section.
4747 SECTION 3. Section 438.043(a), Health and Safety Code, is
4848 amended to read as follows:
4949 (a) The department may not accredit an education or training
5050 program unless the program includes:
5151 (1) four hours of training on the subject of food,
5252 including:
5353 (A) a description of food-borne disease and its
5454 cause and prevention; [and]
5555 (B) protection of food in location, receipt,
5656 storage, preparation, service, and transportation; and
5757 (C) the food allergen awareness information
5858 described by Section 437.027(b);
5959 (2) four hours of training on the subject of food
6060 service facilities, including:
6161 (A) waste disposal and sanitary plumbing and
6262 water;
6363 (B) cleaning and sanitization of dishes and
6464 utensils;
6565 (C) storage of equipment and utensils;
6666 (D) housekeeping procedures and schedules;
6767 (E) proper handling of nonfood supplies,
6868 including single service items, linens, and toxic materials; and
6969 (F) cleanliness of the physical plant, including
7070 building construction, ventilation, lighting, pest control, and
7171 general safety of the environment;
7272 (3) two hours of training on the subject of sanitary
7373 habits for food handlers, including:
7474 (A) personal hygiene, including proper dress,
7575 handwashing, personal habits, and illness;
7676 (B) food handling practices, including minimum
7777 handling and proper use of food service utensils; and
7878 (C) operational problems, including
7979 identification and correction of commonly occurring deficiencies;
8080 and
8181 (4) four hours of training on the subject of
8282 management in the food service industry, including:
8383 (A) self-inspection promotion and techniques;
8484 (B) motivation, including safety, the economics
8585 of safe food handling, and planning to meet sanitation guidelines;
8686 and
8787 (C) personnel training, including management
8888 responsibility, resources, and methods.
8989 SECTION 4. Section 438.103, Health and Safety Code, is
9090 amended to read as follows:
9191 Sec. 438.103. CERTIFICATION AND RENEWAL OF
9292 CERTIFICATION; EXAMINATION REQUIRED. (a) A person who satisfies
9393 the requirements of this subchapter may receive and renew a food
9494 manager certificate by passing a state-approved examination.
9595 (b) A state-approved examination for issuance or renewal of
9696 a food manager certificate must test an applicant on the food
9797 allergen awareness information described by Section 437.027(b).
9898 SECTION 5. Not later than December 1, 2023:
9999 (1) the Department of State Health Services shall
100100 determine the form and content of the poster and post the sample
101101 poster on the department's Internet website as required by Section
102102 437.027, Health and Safety Code, as added by this Act;
103103 (2) the Department of State Health Services shall
104104 update the education or training program as required by Section
105105 438.043, Health and Safety Code, as amended by this Act; and
106106 (3) the executive commissioner of the Health and Human
107107 Services Commission shall adopt any rules necessary to implement
108108 the changes in law made by this Act.
109109 SECTION 6. The changes in law made by this Act apply only to
110110 a food manager certificate issued or renewed on or after September
111111 1, 2024. A certificate issued before that date is covered by the
112112 law in effect when the certificate was issued, and the former law is
113113 continued in effect for that purpose.
114114 SECTION 7. Notwithstanding Section 437.027, Health and
115115 Safety Code, as added by this Act, a food service establishment is
116116 not required to comply with that section before September 1, 2024.
117117 SECTION 8. This Act takes effect September 1, 2023.
