77 relating to electronic voter registration.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subchapter A, Chapter 13, Election Code, is
1010 amended by adding Section 13.009 to read as follows:
1111 Sec. 13.009. ELECTRONIC VOTER REGISTRATION. (a) The
1212 secretary of state shall implement a program to allow a person to
1313 complete a voter registration application over the Internet from
1414 the official state Internet website. The secretary of state and the
1515 Department of Public Safety Internet websites must provide a link
1616 to the application on the official state Internet website.
1717 (b) An applicant for electronic voter registration who has a
1818 state-issued driver's license or personal identification card,
1919 regardless of whether the license or card is unexpired, must:
2020 (1) attest to the truth of the information on the
2121 application by affirmatively accepting the information as true; and
2222 (2) affirmatively consent to the use of the signature
2323 on the applicant's driver's license or personal identification card
2424 for voter registration purposes.
2525 (c) An applicant for electronic voter registration who does
2626 not have a state-issued driver's license or personal identification
2727 card must:
2828 (1) attest to the truth of the information provided on
2929 the application by affirmatively accepting the information as true;
3030 and
3131 (2) print a registration application from the Internet
3232 website the applicant is using to register, sign the application,
3333 and mail it to the registrar.
3434 (d) For each application submitted under Subsection (b),
3535 the program must require that a digital copy of the applicant's
3636 signature be obtained from the Department of Public Safety.
3737 (e) For each application submitted under Subsection (c),
3838 the program must provide the applicant with:
3939 (1) a registration application that the applicant can
4040 print from the registration website, sign, and mail to the
4141 registrar as required under Subsection (c)(2); and
4242 (2) information about how the applicant can obtain a
4343 driver's license or personal identification card from the
4444 Department of Public Safety.
4545 (f) An application submitted under this section is
4646 considered for all purposes an application submitted by mail under
4747 this title.
4848 (g) The secretary of state shall adopt rules as necessary to
4949 implement this section, including rules to provide for security
5050 measures to ensure the accuracy and integrity of applications
5151 submitted electronically.
5252 (h) The rules adopted under Subsection (g) must require
5353 that:
5454 (1) the Internet website through which a person may
5555 complete a voter registration application include a description of
5656 the offense described by Section 13.007 in a conspicuous location
5757 on the website near the place where the person begins or submits the
5858 application; and
5959 (2) the state electronic Internet portal project is
6060 used to authenticate the identity of a person who submits an
6161 application electronically under this section.
6262 SECTION 2. This Act takes effect September 1, 2023.
