55 relating to required military informed care or military cultural
66 competency training for certain personnel of entities that provide
77 mental health services to veterans or veterans' families before
88 award of a state agency grant.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 434.352, Government Code, is amended by
1111 adding Subsections (e) and (f) to read as follows:
1212 (e) A state agency may not award a grant to an entity for the
1313 provision of mental health services to veterans or veterans'
1414 families unless the entity demonstrates the entity:
1515 (1) has previously received and successfully executed
1616 a grant from the state agency; or
1717 (2) provides training on military informed care or
1818 military cultural competency to entity personnel who provide mental
1919 health services to veterans or veterans' families or requires those
2020 personnel to complete military competency training provided by any
2121 of the following:
2222 (A) the commission;
2323 (B) the Health and Human Services Commission;
2424 (C) the Military Veteran Peer Network;
2525 (D) the Substance Abuse and Mental Health
2626 Services Administration within the United States Department of
2727 Health and Human Services;
2828 (E) the United States Department of Defense;
2929 (F) the United States Department of Veterans
3030 Affairs; or
3131 (G) a nonprofit organization that is exempt from
3232 federal income taxation under Section 501(a), Internal Revenue Code
3333 of 1986, by being listed as an exempt entity under Section 501(c)(3)
3434 of that code, with experience in providing training or technical
3535 assistance to entities that provide mental health services to
3636 veterans or veterans' families.
3737 (f) The commission and the Department of State Health
3838 Services shall jointly verify that each state agency authorized to
3939 award a grant subject to the requirements of Subsection (e) has
4040 adopted policies to ensure compliance with Subsection (e).
4141 SECTION 2. The heading to Subchapter I, Chapter 1001,
4242 Health and Safety Code, is amended to read as follows:
4343 SUBCHAPTER I. MENTAL HEALTH SERVICES [PROGRAM] FOR VETERANS
4444 SECTION 3. Subchapter I, Chapter 1001, Health and Safety
4545 Code, is amended by adding Section 1001.225 to read as follows:
4646 Sec. 1001.225. LIMITATION ON GRANTS. The department may
4747 not award a grant to an entity for the provision of mental health
4848 services to veterans or veterans' families unless the entity
4949 demonstrates the entity:
5050 (1) has previously received and successfully executed
5151 a grant from the department; or
5252 (2) provides training on military informed care or
5353 military cultural competency to entity personnel who provide
5454 mental health services to veterans or veterans' families or
5555 requires those personnel to complete military competency training
5656 provided by any of the following:
5757 (A) the Texas Veterans Commission;
5858 (B) the commission;
5959 (C) the Military Veteran Peer Network;
6060 (D) the Substance Abuse and Mental Health
6161 Services Administration within the United States Department of
6262 Health and Human Services;
6363 (E) the United States Department of Defense;
6464 (F) the United States Department of Veterans
6565 Affairs; or
6666 (G) a nonprofit organization that is exempt from
6767 federal income taxation under Section 501(a), Internal Revenue Code
6868 of 1986, by being listed as an exempt entity under Section 501(c)(3)
6969 of that code, with experience in providing training or technical
7070 assistance to entities that provide mental health services to
7171 veterans or veterans' families.
7272 SECTION 4. This Act takes effect September 1, 2023.
