6 | 6 | | competency training for certain personnel of entities that provide |

7 | 7 | | mental health services to veterans or veterans' families before |
---|
8 | 8 | | award of a state agency grant. |
---|
9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
---|
10 | 10 | | SECTION 1. Section 434.352, Government Code, is amended by |
---|
11 | 11 | | adding Subsections (e) and (f) to read as follows: |
---|
12 | 12 | | (e) A state agency may not award a grant to an entity for the |
---|
13 | 13 | | provision of mental health services to veterans or veterans' |
---|
14 | 14 | | families unless the entity demonstrates the entity: |
---|
15 | 15 | | (1) has previously received and successfully executed |
---|
16 | 16 | | a grant from the state agency; or |
---|
17 | 17 | | (2) provides training on military informed care or |
---|
18 | 18 | | military cultural competency to entity personnel who provide mental |
---|
19 | 19 | | health services to veterans or veterans' families or requires those |
---|
20 | 20 | | personnel to complete military competency training provided by any |
---|
21 | 21 | | of the following: |
---|
22 | 22 | | (A) the commission; |
---|
23 | 23 | | (B) the Health and Human Services Commission; |
---|
24 | 24 | | (C) the Military Veteran Peer Network; |
---|
25 | 25 | | (D) the Substance Abuse and Mental Health |
---|
26 | 26 | | Services Administration within the United States Department of |
---|
27 | 27 | | Health and Human Services; |
---|
28 | 28 | | (E) the United States Department of Defense; |
---|
29 | 29 | | (F) the United States Department of Veterans |
---|
30 | 30 | | Affairs; or |
---|
31 | 31 | | (G) a nonprofit organization that is exempt from |
---|
32 | 32 | | federal income taxation under Section 501(a), Internal Revenue Code |
---|
33 | 33 | | of 1986, by being listed as an exempt entity under Section 501(c)(3) |
---|
34 | 34 | | of that code, with experience in providing training or technical |
---|
35 | 35 | | assistance to entities that provide mental health services to |
---|
36 | 36 | | veterans or veterans' families. |
---|
37 | 37 | | (f) The commission and the Department of State Health |
---|
38 | 38 | | Services shall jointly verify that each state agency authorized to |
---|
39 | 39 | | award a grant subject to the requirements of Subsection (e) has |
---|
40 | 40 | | adopted policies to ensure compliance with Subsection (e). |
---|
41 | 41 | | SECTION 2. The heading to Subchapter I, Chapter 1001, |
---|
42 | 42 | | Health and Safety Code, is amended to read as follows: |
---|
43 | 43 | | SUBCHAPTER I. MENTAL HEALTH SERVICES [PROGRAM] FOR VETERANS |
---|
44 | 44 | | SECTION 3. Subchapter I, Chapter 1001, Health and Safety |
---|
45 | 45 | | Code, is amended by adding Section 1001.225 to read as follows: |
---|
46 | 46 | | Sec. 1001.225. LIMITATION ON GRANTS. The department may |
---|
47 | 47 | | not award a grant to an entity for the provision of mental health |
---|
48 | 48 | | services to veterans or veterans' families unless the entity |
---|
49 | 49 | | demonstrates the entity: |
---|
50 | 50 | | (1) has previously received and successfully executed |
---|
51 | 51 | | a grant from the department; or |
---|
52 | 52 | | (2) provides training on military informed care or |
---|
53 | 53 | | military cultural competency to entity personnel who provide |
---|
54 | 54 | | mental health services to veterans or veterans' families or |
---|
55 | 55 | | requires those personnel to complete military competency training |
---|
56 | 56 | | provided by any of the following: |
---|
57 | 57 | | (A) the Texas Veterans Commission; |
---|
58 | 58 | | (B) the commission; |
---|
59 | 59 | | (C) the Military Veteran Peer Network; |
---|
60 | 60 | | (D) the Substance Abuse and Mental Health |
---|
61 | 61 | | Services Administration within the United States Department of |
---|
62 | 62 | | Health and Human Services; |
---|
63 | 63 | | (E) the United States Department of Defense; |
---|
64 | 64 | | (F) the United States Department of Veterans |
---|
65 | 65 | | Affairs; or |
---|
66 | 66 | | (G) a nonprofit organization that is exempt from |

72 | 72 | | SECTION 4. This Act takes effect September 1, 2023. |
